HomeMy WebLinkAbout11412 ORD - 04/04/1973JRR:HG :mc:m1 :4- 10- 73;2nd AN ORDINANCE AMENDING SECTION 4 -4, CORPUS CHRISTI CITY CODE, 1958, SO AS TO PROHIBIT THE SALE OF ALCOHOLIC BEVERAGES AS DEFINED BY ARTICLE 666 -25a, V.A.P.C. WITHIN THE CORPORATE LIMITS OF THE CITY WITHIN THREE HUNDRED FEET OF ANY CHURCH, PUBLIC SCHOOL OR OTHER EDUCATIONAL INSTITUTION OR PUBLIC HOSPITAL; PROVIDING A METHOD OF MEASURING SAID DISTANCE; PRO- VIDING CERTAIN EXCEPTIONS; PROVIDING A PENALTY; PRO- VIDING FOR PUBLICATION; AND PROVIDING SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 4 -4, Corpus Christi City Code, 1958, be and the same hereby is amended to read hereinafter as follows: "Section 4 -4. Same - Prohibited Location. No person shall maintain a place of business for the dispensing and sale for on - premises consumption of alcoholic beverages as defined by Article 666 -25a, V.A.P.C., within the corporate limits of the city within three hundred (300) feet of any church, public school or other educational institution or public hospital. Such distance shall be measured along the property lines of the street fronts and from front door to front door and in a direct line across inter - Sections where they occur. Except, however, any establishment which receives at least 33 1/3% of its gross income from the sale of food, which provides off - street parking for its patrons and whose entrances and exits do not front on a public street, shall be excluded from the prohibition herein." SECTION 2. That any person found guilty of maintaining a place of business in violation of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Two Hundred Dollars ($200). SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. • SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provi- sion of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
