AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, l
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEC,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
I ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
X200 EVERHART CORPORATION BY
AMENDING THE ZONING MAP BY CHANGING THE ZONING ON
PORTIONS OF LOT 4 OSO FARM TRACTS AND LEVEK TRAM,
SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING
DISTRICT TO B- GENERAL BUSINESS
DISTRICT ; KEEPING IN EFFECT ALL OTHER
PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND DECLARING AN EMERGENCY.
WHEREAS, THE PLANNING C014MISSION HAS FORWARDED TO THE CITY
COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF
5200 EVERHART CORPORATION FOR AMENDMENT
TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI, AND
WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS
WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE
THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER
NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON WEDNESDAY,
MARCH 28, 1973 , AT SPECIAL COUNCIL MEETING OF THE CITY
COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS
CHRISTI; AND
WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS
DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH
AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND
THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI, TEXAS, PASSED ON TILE 27TH DAY OF AUGUST, 1937, APPEARING OF
RECORD IN VOLUME 9, Pn cES 565, ET SEO, OF THE ORDINANCE AND RESOLUTION
RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED DY
ORDINANCE NO. 6106, AS AMENDED, BC AND THE SASIE IS HEREDY AMENDED DY
MAKING THE CHANGE IEREINAFTER SET OUT.

1' SECTION 2. THAT THE ZONING OF THE FOLLOWING DESCRIBED PORTIONS
OF LOT 4, OSo FARM TRACTS,AND LEVEK TRACT, SITUATED IN THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, BE AND THE SAME 15 HEREBY CHANGED FROM "R -1B"
ONE FAMILY DWELLING DISTRICT TO "13 -4" GENERAL BUSINESS DISTRICT: -
Being a 3.15 -acre area, more or less, out of Lot 4, Oso Farm Tracts,
Nueces County, Texas, as shown by the map or plat thereof, recorded in
Volume A, Page 49, Map Records of Nueces County, Texas, and being more
particularly described as follows:
CO'�:,tENCING at a 3/4 -inch iron pipe, located on the west right -of -way
line of Everhart Road and the southeast corner of Block C, Levek Tract,
as recorded in"Volume 35, Page 9, Map Records of Nueces County, Texas;
THENCE, south 29° 01 minutes 50 seconds west, a distance of 772.46 feet
to a point, such point being the northeast corner of this tract and the
place of beginning;
TH" NCE, north 60° OB minutes 10 seconds west for a distance of 420 feet
to a point for a corner, such point being the northwest corner of this
tract;
THENCE, south 29° Ol minutes SO seconds west for a distance of 326.23 feet
to a point for a corner, such point being the southwest corner of this
tract;
THENCE south 61° east for a distance of 420 feet to a point fora corner,
on the west righL -of -play line of Everhart Road and the southeast corner
of this Lrdct;

SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS
CHRISTI, TEXAS, BE, AND THE _SAME IS HEREBY, AMENDED AS HEREIN ORDAINED.
SECTION I1. THAT THE .ZONING ORDINANCE AND MAP OF THE CITY OF
CORPUS CHRISTI, TEXAS, APPROVCD ON THE 27TH DAY OF AUGUST, 1937, AS
At FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REI4AIN IN
FULL FORCE AND EFFECT.
SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED.
SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID
CHANGE FOR TILE PURPOSE OF MAINTAINING AT ALL TINES A COMPREHENSIVE ZONING
ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND I
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL SC PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCEOR RESOLUTION SHALL BE READ

DECLARED THAT SUCH EMERGENCY AND NECESSITY EXISTS AND HAVING REQUESTED

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
