AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN ANNEXA-
TION CONTRACT WITH JIM WILBURN FOR THE ANNEXATION
TO THE CITY OF A PARCEL OR TRACT OF LAND OUT OF
TRACT 7, WILLIAM ROBERTSON'S FARM TRACTS, ALL AS
MORE FULLY SET FORTH IN THE ANNEXATION CONTRACT, A
COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN
EMERGENCY.
BE _IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute an annexation contract with Jim Wilburn for the annexation to
the City of a parcel or tract of land out of Tract 7, William Robertson's
Farm Tracts, all as more fully set forth in the annexation contract, a copy
of which is attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to execute the aforesaid contract and
to acquire the parcel or tract of land as described in the attached contract,
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shell be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the Yzj day of April,
1973.

THIS CONTRACT AND AGREEMENT made and entered into in
duplicate originals by and between (1) Tim Wilburn, subject
to a lien in favor of CLM Company, Inc.,
owner(s),
hereinafter called "OWNER(S) ", and THE CITY OF CORPUS CHRISTI,
TEXAS, a home rule city of more than 200,000 population, a
municipal corporation and body politic under the laws of the State
of Texas, situated in Nueces County, Texas, hereinafter called
"CITY ", for good and valuable consideration in hand received by
the parties respectively and upon the covenants and conditions
hereinafter stated
W I T N E S S E T H
That Owners are owners in fee simple and of all existing
rights, titles (1A) and interests therein of all the following
described property located in(2) Nueces County, Texas,
adjacent to and adjoining the corporate limits of the City of
Corpus Christi, lying wholly within the extraterritorial juris-
diction of said City and, in whole or in part, within three hundred
(300) feet of the City's present corporate limits, generally deline-
ated on the map attached hereto and marked "Exhibit A ", and being
more particularly described as follows, to -wit:
Being an 8.41 acre tract of land out of Tract 7, William Robertson's Farm
Tracts, as shown by map of record in Volume 3, page 31, Nap Records, Nueces
County, Texas, a portion of Saratoga Boulevard, said 8.41 acre tract of
land being more particularly described by metes and bounds as follows:
' BEGINNING at a point, the northwest corner of said Tract 7,
William Robertson's Farm Tracts, for the northwest and beginning
corner of the tract herein described;
THENCE N. 890 49' 45" E., with the north boundary line of said .
Tract 7 a distance of 434.64 feet to its intersection with the
southwest right -of -way line of 120 foot wide Saratoga Boulevard;
J11ENCE N. 280 46' 45" E., across said Saratoga Boulevard, a
distance of 120.0 feet to its northeast right -of -way line, said
point being in the present southwest City Limits line of the
City of Corpus Christi;
THENCE S. 610 13' 15" E., with the northeast right -of -way line of
said Saratoga Boulevard, and with the present City Limits line
a distance of 308.51 feet- to a point;

THENCE S. 290 10' 43" W., across said Saratoga Bouievard.at 120.0
feet past its southwest right -of -way line, in all a distance of
6ot.o? -- 720.02 feet to a point, the most southerly corner of the tract
herein described;
THENCE N. 610 13' 15" W., a distance of 466.57 feetrto a point
in the west boundary line of said Tract 7 for the southwest
corner of the tract herein described;
THENCE N. 00 22' W., with the west boundary line of said Tract 7
a distance of 446.09 feet to the POINT OF BEGINNING
Containing 8.41 acres of land more or less.

•IT IS AGREED by and between the parties hereto that the
above described land and territory shall be included within the
corporate boundaries of the City of Corpus Christi, Texas, and
shall become a part thereof, subject to the terms of Article I,
Section 2 of the City Charter of Corpus Christi, as amended, and
as further prescribed by ordinance No. 11139 of the City of Corpus
Christi.(4), (5), (6)
That all of the above conditions. shall be binding upon
