HomeMy WebLinkAbout11453 ORD - 04/04/1973JRR /Mc 14/11/73 1ST AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE FOR AND ON BEHALF OF THE CITY A CONTRACT WITH THE YWCA FOR CRISIS INTERVENTION SERVICE NOT TO EXCEED $2,500, ALL IN ACCORDANCE WITH THE ATTACHED CONTRACT MARKED EXHIBIT "A" AND MADE A PART HEREOF, THE SAME AS IF WRITTEN HEREIN; APPROPRIATING $2,500 FROM INTEREST EARNED TO FUND 121, ACTIVITY 3361; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER 1S AUTHORIZED AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A CONTRACT WITH THE YWCA FOR CRISIS INTERVENTION SERVICE NOT TO EXCEED $2,5500, ALL IN ACCORDANCE WITH THE ATTACHED CONTRACT MARKED EXHIBIT "A" AND MADE A PART HEREOF, THE SAME AS IF WRITTEN HEREIN. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $2,500 FROM INTEREST EARNED FROM FUND 121, ACTIVITY 3361. SECTION 3. THE NECESSITY TO ENTER INTO THE AFOREMENTIONED CONTRACT AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _ DAY OF APRIL, 1973• ATTEST • Wlo4l 10 CITY SE�TY MAYOR APPROVED: THE CITY 0 RP CHRISTI, TEXAS DAY F IL, 1973. C Y T N E Y I 1 -153 • JRR /MC 11/11 /73 15r • STATE OF TEXAS ) COUNTY OF NUECES ) W 11 N E S S E T H: FOR AND IN CONSIDERATION OF THE PAYMENTS,SERVICE AND COVENANTS HEREIN, DO THE CITY OF 'CORPUS CHRISTI, HEREINAFTER CALLED "CITY ", A MUNICIPAL CORPORATION AND BODY POLITIC, UNDER THE LAWS OF THE STATE OF TEXAS, AND THE CORPUS CHRISTI YWCA, COVENANT, AGREE AND CONTRACT AS FOLLOWS: I THE YWCA WILL PROVIDE A CRISIS INTERVENTION SERVICE AND TEMPORARY RESIDENCE SERVICE FOR YOUNG LADIES HAVING HAD SOME CONTACT WITH A LAW ENFORCE- MENT AGENCY. UPON THE FURNISHING OF SUCH SERVICE, THE YWCA WILL BILL THE CITY FOR A REASONABLE FEE FOR THE PROVISION OF SAID SERVICE. YWCA AGREES THAT THE TOTAL AMOUNT PAID BY THE CITY OVER THE TERM OF THIS CONTRACT SHALL NOT EXCEED TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500). 11 THE CITY AGREES TO PAY YWCA A REASONABLE AMOUNT FOR THE PROVISION OF SUCH SERVICE UPON RECEIPT AND APPROVAL OF AN INVOICE SHOWING THE SERVICE RENDERED. YWCA AGREES TO KEEP ADEQUATE RECORDS TO SUBSTANTIATE SUCH SERVICE AND TO MAKE SUCH RECORDS AVAILABLE FOR INSPECTION BY THE CITY DURING NORMAL OFFICE HOURS. THE REIMBURSEMENT PROVIDED HEREUNDER SHALL NOT EXCEED Two - THOUSAND FIVE HUNDRED DOLLARS ($2,500). III THE TERM OF THIS CONTRACT SHALL BE FROM EXECUTION HEREOF TO AND UNTIL JULY 31, 1973. HOWEVER, IN THE EVENT YWCA OBTAINS OTHER FUNDING FOR SUCH SERVICES, THE CITY WILL HAVE NO FURTHER LIABILITY HEREUNDER AND THIS CONTRACT IS TERMINATED UPON RECEIPT OF SUCH OTHER FUNDING.
