BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE AN AGREEMENT WITH T. RICHARD CLOWER FOR PEAL ESTATE APPRAISAL SERVICES FOR BLOCKS 90 AND 91 OF BEACH ADDITION IN THE BAYFRONT SCIENCE PARK, A COPY OF WHICH IS ATTACHED HERETO, MARE: ED EXHIBIT "A ", AND MADE A PART HEREOF. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE NO. 102 GENERAL FUND, ACTIVITY NO. 11181, CODE 301, THE SUt. OF $11,250 FOR SAID SERVICES. SECTION 3. THE NECESSITY TO EXECUTE AN AGREEMENT FOR REAL ESTATE APPRAISAL SERVICES AND TO APPROPRIATE THE HEREI ?±.ABOVE SUMS SET FORTH AT THE 'L6RLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF d THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON TIIE DATE_ OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY F APRIL, 1973. Richard Clower � and pertains to the (''Party of the Second Part ") being referred to as 'Appraiser', Appraisals subject to possible Eminent Domain action of preparation of Real Estate App Beach Addition 90 & 91 of properties located in Blocks acquired by the consisting of approximately 14 parcels, said properties are to be City in connection with the Convention Center project, NOW THE the City and the Appraiser agree as follows: A. The Appraiser will provide the following: (1) Prepare appraisal reports of properties consisting of approximately 14 parcels of Blocks 9_ 0 __ and 91 Beach Addition, Corpus Christi, Texas. (2) Submit three (3) bound copies of reports for each parcel showing comparable and approach data, maps, discussion of present use and highest and best uses as well as photographs and appraised value. (7) llhc Appraiser agrees, upon the City's request, to make preparations for Court testimony and appear in Court to testify, in support of his appraisal, for a fee applicable to the project and to be negotiated at that time. (g) The Appraiser will comply with all Federal, State and local laws and ordinances applicable to the work. (g) The Appraiser agrees to hold the City of Corpus Christi harmless from any claims and liability due to activities of himself, his agents, or employees. B. The City agrees to provide the following to the Appraiser: (1) Furnish title reports and legal descriptions. ment (2) Prepare surveys of each parcel involved on their particular assign on the project. The surveys shall show in detail all improvements. (3) Provide the Appraiser with information regarding tax value, assessments and taxes. (4) Provide information on cormparables if any are available to the City. C.
