AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH R. V. COULTER FOR REAL ESTATE APPRAISAL SERVICES
FOR BLOCKS 79 AND 89 OF BEACH ADDITION IN THE BAYFRONT
SCIENCE PARK AREA, AS MORE FULLY SET FORTH IN THE
AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE
A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING OUT
OF THE N0. 102 GENERAL FUND, ACTIVITY 4181, CODE 301
$12,500 FOR SAID SERVICES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with R. V. Coulter for real estate appraisal services
for Blocks 79 and 89 of Beach Addition in the Bayiront Science Park Area,
all as more fully set forth in the agreement, a copy of which is attached ,
hereto and made a part hereof, marked Exhibit "A ", and made a part hereof.
SECTION 2. There is hereby appropriated out of the No. 102
General Fund, Activity 4181, Code 301 the sum of $12,500 for said services.
SECTION 3. The necessity to immediately authorize the City Manager
to execute the aforesaid agreement for real estate appraisal services creates
a public emergency and imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
day of April, 1973.

and is entered into between the City of Corpus Christi, Texas. ( "Party of the First
Part ") hcrrinafter called City, and R. V. Coulter
( "Party of the Second Part ") being referred to as 'Appraiser ", and pertains to the
Preparation of Real Estate Appraisals subject to possible Eminent Domain action of
properties located in Blocks 79 & 89 of Beach Addition
consisting of approximately 16 parcels, said properties are to be acquired by the
City in connection with the Convention Center project.
NO'a THEREFORE, the City and the Appraiser agree as follows:
A. The Appraiser will provide the following:
(1) Prepare appraisal reports of properties consisting of approximately
16 parcels of Blocks 79 and 89 , Beach Addition,
Corpus Christi, Texas.
(2) Submit three (3) bound copies of reports for each parcel showing
comparable and approach data, maps, discussion.of present use and
highest and best uses as well as photographs and appraised value.
The reports should show the approaches used in determining-the appraised
value for each parcel.
(3) The Appraiser will provide said appraisals within T days after
the City has furnished all necessary data on the project.
(4) The Appraiser agrees to share information on comparable sales in the
area in a cooperative c:anncr with other appraisers appraising in tite
area for the City.
(5) The Appraiser a;rccs to coordinate all wort: with the City DepartmeuL
of Engineering Services and shall sttbrii.t all reports to the Depart:mcnt
upon completion.

the appraisal report to the City or not, is to be treated as coufideu-
tial and a breach of such confidence by the Appraiser, except on wrt.tten
authorization by the City or upon proper order of the Court, shall be
considered a material breach of this contract.
(7) The Appraiser agrees, upon the City's request, to make preparations
for Court testimony and appear in Court to testify, in support of his
appraisal, for a fee applicable to the project and to be negotiated at
that time.
(8) The Appraiser will comply with all Federal, State and local laws and
ordinances applicable to the work.
(9) The Appraiser agrees to hold the City of Corpus Christi harmless from
any claims and liability due to activities of himself, his agents, or
employees.
B. The City agrees to provide the following to the Appraiser:
(1) Furnish title reports and legal descriptions.
(2) Prepare surveys of each parcel involved on their particular assignment
on the project. The surveys shall show in detail all improvements.
(3) Provide the Appraiser with information regarding tar, value, assessments
and taxes.
(4) Provide information on comparables if any are available to the City.
C. Payment:
For and in consideration of the work to be performed by the Appraiser, the
City agrees t:o pay the Appraiser upon completion of his assignment and
submission of three (3) copies of the Appraisal Report bound separately for

D. Termination:
The Ci.ty roserves the ril,ht to terminate this contract with cause at anvtic;e.
