HomeMy WebLinkAbout11469 ORD - 05/02/1973• jRR ;JKH:5 -2-73; 1st AN ORDINANCE • CLOSING A PORTION OF THE EXISTING RIGHT OF WAY OF WOOLDRIDGE ROAD, SITUATED IN LOTS 9, 10, 2 M AND GARDENST TRACTS, RECORDED IN & N F VOL. A, PAGES 41, 42 AND 43, MAP RECORDS OF NUECES COUNTY, TEXAS, MORE FOLLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of a portion of the existing right of way of Wooldridge Road, situated in Lots 9, 10, 11, 22,,23 and 24, Section 4, Flour Bluff & Encinal Farm and Garden Tracts, as recorded in Vol. A, pages 41, 42 and 43, Map Records of Nueces County, Texas, said right of way being more fully described hereinafter, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and registered mail to the last known addresses of the owners of property abutting said street right of way and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, April 25, 1973, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the street right of way within the limits hereinafter set forth for use as a public street, subject to its relocation in accordance with final plat of Country Club Estates Unit 15: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portion of the right of way of Wooldridge Road situated in Lots 9, 10, 11, 22, 23 and 24, Section 4, Flour Bluff & Encinal Farm and Garden Tracts, as recorded in Vol. A, pages 41, 42 and 43, Map Records of Nueces County, Texas, more particularly described by metes and bounds as follows: f 4U9 • T BEGINNING at the most easterly corner of Lot 24, the centerline intersection of south Staples Street and Trloo459.46efeetdt0Vaepoint lin the centerline of Wooldridge Road N 62018129" W 459• southeast boundary line of this tract and the POINT OF BEG IIVNING; THENCE S 27041'31" W 30 feet to the southerly right -of -way line of Wooldridge Road for the southeast corner of this tract; THENCE with said right -of -way line N62018129" W 858.88 feet to an angle point; THENCE N 68041' W 400 feet to the southwest corner of this tract; THENCE crossing the right -of -way of Wooldridge Road N 21019' E 60 feet to the northerly right -of -way line of Wooldridge Road for the north- west corner of this tract; THENCE with said right -of -way line S 68041' E 403.34 feet to an angle point; THENCE S 62018'29" E 862.22 feet to the northeast corner of this tract; THENCE S 27041'31" W 30 feet to the centerline of Wooldridge Road and the POINT OF BEGINNING. be and the same is hereby closed for public use as a public street and abandoned to the owners of the abutting property, subject, however, to the relocation of Wooldridge Road in accordance with final plat of Country Club Estates Unit 15, as described on the map attached hereto and made a part hereof. SECTION 2. If for any reason any section, paragraph, subdivi- sion, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent juris- diction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof shall be given full force and effect. SECTION 3. The necessity to immediately close the aforesaid street right of way for use as a public street and abandon the same to the owners of abutting property so that the same may be used for other purposes creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this -2- ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and afterits passage, IT IS ACCORDINGLY ' SO ORDAINED, this the�g _day of May, 1973.
