WHEREAS, HERETOFORE ON THE 4TH DAY OF APRIL, 1973, THE MAYOR OF THE CITY OF CORPUS CHRISTI CAUSED TO BE PUBLISHED A PROCLAMATION ANNOUNCING THE GENERAL ELECTION TO BE HELD ON THE 5TH DAY OF MAY, 1973; AND WHEREAS, NOTICE OF SAID ELECTION WAS ACTUALLY GIVEN AS REQUIRED BY LAW AND AS DIRECTED IN THE SAID PROCLAMATION, AS IS SHOWN BY AFFIDAVIT PROPERLY FILED IN THE OFFICE OF THE CITY SECRETARY; AND WHEREAS, SAID ELECTION WAS DULY AND LEGALLY HELD ON THE 5TH DAY OF MAY, A.D., 1973, IN CONFORMITY WITH THE ELECTION LAWS OF THE STATE OF TEXAS, AND THE RESULTS OF SAID ELECTION=HAVE (BEEN CERTIFIED AND RETURNED BY THE PROPER JUDGES AND CLER$S THEREOF; AND ' WHEREAS, THIS COUNCIL HAS TODAY CONSIDERED THE RETURNS OF SAID rt .. ELECTION HELD ON THE 5TH DAY OF MAY, 1973; AND f 't WHEREAS; If APPEARS TO THE COUNCIL, AND THE COUNCIL SO FINDS, THAT THE SAID ELECTION WAS IN ALL RESPECTS LAWFULLY HELD; AND a WHEREAS, IT APPEARS TO THE COUNCIL, AND THE COUNCIL SO FINDS, THAT THE CITY SECRETARY HAS TABULATED THE RESULTS OF SAID ELECTION AND CERTIFIED SUCH TABULATION TO THE COUNCIL-, AND THAT SUCH TABULATION IS CORRECT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE TABULATION OF VOTES CAST IN THE GENERAL • ELECTION HELD ON THE 5TH DAY OF MAY, 1973, MADE AND CERTIFIED TO BY THE CITY SECRETARY OF THE CITY OF CORPUS CHRISTI, A COPY OF WHICH IS ATTACHED HERETO -, AND MADE A PART HEREOF, BE AND THE SAME IS HEREBY ADOPTED AS THE OFFICIAL TABU- LATION OF THE VOTES CAST AT SAID ELECTION AND THAT SAID TABULATION BE FILED AND RECORDED IN THE OFFICIAL RECORDS OF THE CITY OF CORPUS CHRISTI AS THE OFFICIAL CANVASS OF SAID ELECTION. THAT THE OFFICIAL CANVASS OF THE RETURNS OF SAID ELECTION REFLECTS THAT THE FOLLOWING WERE DULY ELECTED COUNCILMEN: COUNCILMAN HOWARD STARK PLACE #1 COUNCILMAN THOMAS V. GONZALES ' PLACE #2 COUNCILMAN GABE LOZANO, SR. PLACE #3 1 COUNCILMAN .JAMES T. ACUFF PLACE #4 COUNCILMAN REVEREND HAROLD T. BRANCH PLACE #5 COUNCILMAN RICARDO V. GONZALEZ PLACE #6 THAT NONE OF THE CANDIDATES FOR THE OFFICE OF MAYOR RECEIVED A MAJORITY OF ALL VOTES CAST AT SAID ELECTION FOR SUCH RESPECTIVE OFFICE, .1: THEREBY NECESSITATING A RUN -OFF ELECTION, IN COMPLIANCE WITH THE TERMS OF THE STATE LAW AND THE CITY CHARTER. SECTION 3. THE NECESSITY OF MAKING AN OFFICIAL CANVASS OF VOTES CAST IN THE AFORESAID ELECTION AND DECLARING THE SAID RESULTS OF SAID ELECTION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY-OF MAY, 1973• ATTEST: / O Lo Aftd 42 CITY SECRETARY / MAYOR (/ THE CITY OF COR S CHRISTI, TEXAS APPROVED: ' D Y MAY, 1973: C YY TO NEY. i c' 1 .
