AN ORDINANCE
APPROPRIATING OUT OF THE NO. 245 AIRPORT BOND FUND
$6,672.62 APPLICABLE TO PROJECT NO. 245-68 -11.3,
TO REIMBURSE THE TEXAS HIGHWAY COMMISSION FOR
ENGINEERING SERVICES PERFORMED IN CONNECTION WITH
THE RELOCATION OF FARM ROAD 763; AND DECLARING AN
EMERGENCY.
WHEREAS, by authority of Ordinance No. 9724, passed and approved
by the City Council on April 22, 1970, the City of Corpus Christi entered
into an agreement with the State of Texas for the relocation of a portion
of FM 763, which relocation was made necessary by the extension of runways
at the Corpus Christi International Airport; and
} WHEREAS, in accordance with the aforesaid agreement between the
City and the State of Texas, the City was to pay for all the preliminary
engineering, construction costs and construction engineering; and
WHEREAS, after completion of the plans in July, 1971, it was
determined that the location of said FM 763 would not interfere with the
` instrument landing equipment at the International Airport and plans
for relocation of the listed highway were cancelled; and
WHEREAS, the City is desirous of reimbursing the State for engi-
veering services performed in connection with the aforesaid agreement:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated out of No. 245
Airport Bond Fund $6,672.62, applicable to.Project No. 245 -68 -11.3, for
reimbursement of the Texas Highway Commission for engineering services per-
formed in connection with the Relocation of Farm Road 763.
SECTION 2. The necessity to immediately provide the necessary
funds to reimburse the Texas Highway Commission for engineering services
as outlined above creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction and that
such resolution and ordinance shall be read at three several meetings of the
City Council, and the Mayor having declared that such public emergency and
necessity exist, and having requested that such Charter rule be suspended and
that this ordinance be passed finally on the date its introduction and take

effect and be in full force and effect from and after its pass4ge, IT

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
