HomeMy WebLinkAbout11523 ORD - 06/13/1973OJRR:HG:jkh:6-13 -73; Ist AN ORDINANCE < AMENDING ORDINANCE NOS. 11482 AND 11505, PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 30, 1973, ORDERING THE IPIPROVEMENT OF CERTAIN STREETS IN THE CITY OF CORPUS CHRISTI, SO AS TO CORRECT ITEM 2 TO HEREAFTER READ AS FOLLOWS: "2. ESPINOSA STREET, FROM REYNA STREET TO HIGHLAND AVENUE "; 3� „ PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance Nos. 11482 and 11505, passed and approved by the City Council on May 30, 1973, certain street improvements were ordered; and WHEREAS, the limits for Espinosa Street was erroneously designated from Presa Street to Highland Avenue; and WHEREAS, it is the desire of the City Council to immediately correct this erroneous designation as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance Nos. 11482 and 11505, passed and approved by the City Council on May 30, 1973, ordering the improvement of certain streets in the City of Corpus Christi, be and the same hereby are amended by correcting Item 2 as follows: "2. Espinosa Street, from Reyna Street to Highland Avenue." SECTION 2. Except as hereby amended, the terms and conditions of Ordinance Nos. 11482 and 11505 shall be and remain in full force and effect. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a dourt of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. The necessity to immediately correct the Ordinance Nos. 11482 and 11505 as hereinabove set forth creates a public emergency and 11523 �` t o an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 3,,day of June, 1973. ATTEST: MAYOR THE CITY OF CORPUS CHRISTI, TEXAS Corpus Christi, Texas /9-bL day of Qt .n a. 1973 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
