L.,RANKIN BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A" FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -1" APARTMENT HOUSE DISTRICT, AND CHANGING THE ZONING OF TRACT "B" FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT, SAID TRACTS 'BEING A PORTION OF LOTS 25 AND 26, SECTION 18, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. 1•lHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF A. L Rankin FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND 4- !HEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAKE BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON September 6, AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IIJ THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD LEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COYPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONINC ORDINANCE OF THE CITY OF CORPUS CHRISTI, Tr XA!S, PASSED ON TIIE 27111 DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOL UF:C 9, PAGES 505, ET SEQ, OF THE ORDINANCE ACID RESOLUTION RECORDS, AS AMI:IIDED FROM TI;:E TO TIRE, AND IN PARTICULAR AS AMENDED BY ORDINANCE ND_. 6106, AS A1:Lt.UFO, HE AND THE SAIIE IS IIF.RLDY AilENDED DY MARINO 111E CIfAfIGE 1tEREINAFTFR :.ET OUT. 4.1546 SECTION 2. That the zoning of Tract "A ", hereinafter more fully described, be and the same is hereby changed from "R -1B" One Family Dwelling District to "A -1" Apartment House District, and the zoning of Tract "B ", hereinafter more fully described, be and the same is hereby changed from "R -1B" One Family Dwelling District to "B -4" General Business District: TRACT "A" Being a tract or parcel of land, consisting of 17.3 acres, more or less, situated in Lots 25 and 26, Section 13, Flour Bluff and Encinal Farm and Garden Tracts in Nueces County, Texas, more particularly described as follows: BEGINNING at the most westerly corner of Candlewood Addition Unit 7 as recorded by map filed in Volume 36 Page 165 of the map records of said county for the northwest corner and POINT OF BEGINNING of this tract; THENCE with the southwest boundary line of Candlewood Addition Unit 7 S 61° E 1280 feet, more or less, to the northeast corner of this tract; THENCE S 29° W 680 feet, more or less, to the southeast corner of this tract; TIiENCE N 61° W 940 feet, more or less, to the east right -of -way lire of Airline Road for the southwest corner of this tract; THENCE with said right -of -way line N 2 °30' E 760 feet, more or less, to the POINT OF BEGINNING. TRACT "B" Being a tract or parcel of land, consisting of 10.9 acres, more or less, situated in Lots 25 and 26, Section 13, Flour Bluff and Encinal Farm and Garden Tracts in Nueces County, Texas, more particularly described as follows: BEGINNING at the northeast corner of the intersection of Airline Road and Holly Road for the southwest corner and POINT OF BEGINNING of this tract; THENCE with the 'east right -of -way line of Airline Road N 2°30' E 670 feet, more or less, to the northwest corner of this tract; THENCE S WE 940 feet, more or less, to the northeast corner of this tract; THENCE S 29N 600 feet, more or less to the northeast right -of -way line of Holly Road for the southeast corner of this tract; THENCE with said right -of -way line•N 61 °W 640 feet, more. or less, to the POINT OF BEGINNING. -2- SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY or CORPUS CHRISTI, TEXAS, DE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION I1. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TINE TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORD114ANCES OR PARTS OF ORD114ANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALCO. SECTION 6. THAT THE NECESSITY OF IMtdED1ATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TINES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT 140 ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND 'HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON TFC DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT 15 ACCORD114GLY SO ORDAINED, THIS THE�DAY OF- �y ATTEST .0 CI1 Scot[ rn reY /` f lnWr% APPPR ED: J THE CITY OF CORPUS CHRISTI, TEXAS �- -'r�G1 Dn��%y�" � / 3 9—J ST CI F1• Ai iDI r. Corpus Christi, Texas 22.stL..day of Qw,.._. , p- TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
