A RESOLUTION

REQUESTING PROPERTY OWNERS LOCATED UNDER THE FLIGHT
PATTERN AT THE NAVAL AIR STATION, WALDRON FIELD,
CABANISS FIELD, AND C. C. INTERNATIONAL AIRPORT TO
DISCONTINUE BUILDING AND DEVELOPMENT IN THE VICINITY
OF THE FLIGHT PATH OF THE RESPECTIVE AIRFIELDS UNTIL
A STUDY CAN BE COMPLETED TO DETERMINE UNIFORM CONDI-
TIONS AND REGULATIONS THAT SHOULD EXIST IN THE AREA
TO PROTECT BOTH THE PROPERTY OWNERS AND THE RESPECTIVE
AIRFIELDS; AND DECLARING AN EMERGENCY.
WHEREAS, the City is experiencing growth in all directions and
particularly in the areas around and lying in the flight patterns of the
Naval Air Station, Waldron Field, Cabaniss Field, and C.C. International
* Airport; and
WHEREAS, the flight patterns in and around said fields are charac-
terized by a high degree of noise which creates a detrimental effect on the
peaceful enjoyment of the normal household environment; and
WHEREAS, said noise created by the consistent flight patterns and
" the consistent flights of high speed jet- propelled aircraft creates a hazard
?4 to the peaceful enjoyment of occupied buildings; and
WHEREAS, said airfields are important to the economic well -being
of the City and development in and around those areas constitutes a threat
to the continued use and expansion of said fields; and
WHEREAS, the City Council and City Staff presently have under study
the formulation of a plan to determine uniform conditions and regulations
that should exist in said areas to protect both the property owners and the
said airfields; and
WHEREAS, said plan is vitally necessary for the protection of the
general welfare for the protection and benefit of the whole community and
particularly those property owners and residents of said areas;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the property owners of land located under the
flight patterns at the Naval Air Station, Waldron Field, Cabaniss Field,
and C.C. International Airport are hereby requested to discontinue building
and development in the vicinity of the flight path of the respective airfields
until a study can be completed to determine uniform conditions and regulations
that should exist in the area to protect both the property owners and the
respective airfields.

SECTION 2. The necessity to protect private property rights, protect
public health and to give time to formulating a plan for uniform development
in the aforementioned areas creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO RESOLVED, this the _day of July, 1973.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
