HomeMy WebLinkAbout11578 ORD - 07/18/1973JRR:jkh:7 -9 -73; 1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9•, PAGES 565, ET SEQ1, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TLIE AND PARTICULARLY AS A14ENDED BY ORDINANCE 110. 6106, AS AMENDED, UPON APPLICATION OF WILLIAM McBRIDE, JR., BY AMENDING THE ZONING MAP BY CHANGING THE 'ZONING ON PORTION OF LOT 26, SECTION 49, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, AND A PORTION OF LOT 27, SECTION 49, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, RROlI "R -lB" ONE FAMILY DWELLING DISTRICT TO "R -2" TWO FAMILY DWELLING DISTRICT AND "A -1'I APARTMENT.HOLSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS.FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERN114G THE APPLICATION] OF William McBride. Jr. FOR AMENDMENT TO THE ZON114G MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HE ALL PERSONS WISHING TO APPEAR AND BF. HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, 114 ACCORDANCE WITH PROPER , NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON Their cria�r*,r_ July 5, 1973 , AT Special COUNCIL MEETING OF T14E CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL,IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE A14D THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS•CITIZ'ENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CIIRISTI, TEXAS, PASSED ON THE 27TIl DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SER, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AME NDED FROM TIME TO TIME, AND IN PARTICULAR AS AHCNDED BY ORDINANCE NO. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING lHE CIIANGC HEREINAFTER SET OUT. THAT Inc ZONING of portions of Lots 26 and 27, Section 49, Flour Bluff & Encinal Farm & Garden Tracts, be and the same is hereby changed from "R -1B" One Family Dwelling District to "R -2" Two Family Dwelling District on that portion hereinafter• described as Tract "A ", and from "R -1B" One Family Dwelling District to "A -1" Apartment House District'on Tract "B ": Being a portion of Lots 26 & 27, Section 49, Flour Bluff & Encinal Farm & Garden Tracts, as recorded in Volume A, pages 41 - 43, Nueces County Hap Records, Nueces County, Texas; Tract A: (P. -1B to R -2), Beginning at a 5/8" iron rod located on the northeast corner of Lot 1, Tract 3, Waldron Subdivision Annex, as recorded in Volume 37, page 177, and also the southwest corner of Waldron Subdivision Unit 2, filed in Volume 15,* Page 57, both subdivisions recorded in Nueces County hap Records, Nueces County, Texas; Thence south 28° 58 minutes 21 seconds west- for a distance of 660' along the west line of Lot 28 „ Section 49, to'a point for corner, such point being the north right -of -way line of Glenoak Road; Thence south 61° 00 minutes'07•seconds east for a distance of 589' along the north right -of -way line of Glenoak Road to a point for corner; Thence north 28° 58 minutes 21 seconds east for a distance of 660' to a point for corner, such point being on the south boundary line of Waldron Subdivision Unit 2 and the center line of Lorire Drive; Thence north 51° 03 minutes 00 seconds west along the south boundary line of Waldron Subdivision Unit 2 to the place: of beginning, such area containing approximately 8.92 acres, more or less. Tract B: (R -1B to A -1), Beginning at a 5/8" iron rod located on the northeast corner of Lot 1, Tract 3,'Waldron Subdivision Annex, as recorded in Voluq.m 37, page 177, and also the southwest corner of Waldron Subdivision Unit 2, filed in Volume 15, Page 57, both subdivisions recorded in Nueces County Map Records, Nueces County, Texas; Thence south 51° 03 minutes 00 seconds east for a distance of 589' along the south boundary line of Waldron Subdivision Unit 2 to a point for corner on the center line of Lorine Drive, such point being the place of beginning; Thence continuing south 51° 03 minutes 00 seconds east for a distance of 401' to a point for corner, such point also being the southeast- corner of Waldron Subdivision Unit 2; Thence south 28° 68 minutes 21 seconds west for a distance of of 660' to a point for corner, such point being on the north right - of-way line of Clenoak Road; -2- Thence north 61° 00 minutes 07 seconds west for a distance of 401` along the north right -of -way line of Glenoak Road to a point for corner; Thence north 28° 68 minutes 21 seconds east to the place of beginning, such area containing approximately 6.08 acres, more or less. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HCREDY, AHENDED AS HEREIN ORDAINED. SECTION II. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRIST!, TEXAS, APPROVED ON THE 27TII DAY OF AUGUST, 1937, AS AMENDED FROM TIME 1 "0 TIME, EXCEPT AS HEREIN CHANGED) SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES 114 CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THC 1ECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL-TI14ES A COMPREHENSIVE 20NING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC E11ERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL DE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL DE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY -EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON TFL DATE OF ITS INTRODUCTION A14D TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE / iJ DAY OF Jul V. 1973 ATTEST CIT�iCT .RY / 7 D: .
