ORDI.Nf.CCES IN CONFLICT HEREWITH; AND DECLARING AN Et;-RGz_NCY. la'HEP,EAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERN114G THE APPLICATION OF '• _� Tim lower FOR AMENDMENT I' TO THE ZOIIING 14AP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON TThurGdaT- July 5. 1973 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL "IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITI7.ENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937) APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROI4 TIME TO TfME, AND IN PARTICULAR AS AHENDED BY ORDINANCE NO. 6106, AS AHENDED, BE AND THE SAME IS HEREBY AMENDED BY HAVING 114E CHANGE HEREINAFTER SET OUT. SECTION P. •IHAT THE ZONING (IF the following described portion of Lot 5, Blk. 1, A Barthlome's Acre Tracts, situated in Nueces County, Texas, be and the same is hereby changed from "R -1B" One Family Dwelling District to "A -l" Apartment House District: Being a portion of Lot 5, Barthlome's Acre Tracts, as recorded in Volume 5, page 7, Nueces County 11ap Records, Nueces County, Texas; Beginning at the southeast corner of Lot 5, Barthlome's Acre Tracts, such point located along the north right -of -way line of UpRiver Road; Thence north 71° 21 minutes 20 seconds crest for a distance of 120' to a point for corner, such point being the southeast corner of Lot 5, located on the north right -of -way line of UpRiver road; Thence north 18° 32 minutes 40 seconds cast for a distance of 155' to a point for corner; Thence south 71° 21 minutes 20 seconds east for a distance of 120' to a point for corner, such point being the northeast corner of Lot 8 and the southeast corner of Lot 9•, Barthlome's Acre Tracts; Thence south 18° 32 minutes 40 seconds west to the place of beginning, such area containing approximately•0.43 acres, more or less. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, DE, A140 THE' SANE IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION II. THAT THE ZONING Of2DIN'ANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REHAIN IN FULL FORCE AND EFFECT. SECT 10.4 j. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREUY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHARGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL. CITY AT ICY I4AY THE CITY OF CORPUS CHRISTI, TEXAS Corpus Christi, Texas day o411-1 19 7J TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
