AMENDING ORDINANCE NO. 11392; APPROVING A NEW RATE SCHEDULE FOR THE FURNISHING OF ELECTRICITY AND ELECTRIC SERVICE WITHIN THE CITY OF CORPUS CHRISTI, TEXAS, BY CENTRAL POWER & LIGHT COMPANY; REQUIRING A WRITTEN STATEMENT ON COST OF FUEL; PROVIDING THAT THIS ORDINANCE' SHALL NOT LIMIT POWERS OF REGULATION OF THE CITY; REPEALING ALL PARAGRAPHS AFTER THE CAPTION AND BEFORE THE ORDAINING CLAUSE OF SAID ORDINANCE AND SUBSTITUTING THEREFOR NEW RECITALS AND FINDINGS 0 FACT; REPEALING IN ORDINANCE NO. 11392 SECTIO 2, 3, 6 AND 8, AND PROVIDING GENERAL REPEAL LAUSE; PROVIDING SEVERABILITY; AND PR' DING AN •�, CTIVE DATE. WHEREAS, Central Power and Light C 1 any has appeared before the City Council requesting approval of new ates , furnishing electricity 'and electric service within the C y of Corpus C ti; and WHEREAS, a public hea s held on s request on December 13, cember 19, 197 , January 3, 1972, and continuing as a re 1973, January 31, 1973; and WHEREAS, at y c Company,'Corpus Christi C nsumers Ass.ciation, th City and citizens appeared and gave deuce a. s •porting d- a regardin: the Company's fair value rate base an f e of retu , using 197' as an agreed test year, such requested at and schedules; and 1r i sed hearing on hearings r resentative- of Central Power & Light AS, at th completion said public hearings the City Council passed and approved, on March 1, 1973, Ordinance No. 11,392; and WHEREAS, pursuant to Article VIII, Section 7 of the Charter of the City of Corpus Christi, Central Power and Light Company filed a Motion for Rehearing, which Motion, arguments and evidence were duly heard and received by the City Council on July 2, 1973; July 11, 1973; July 18, 1973, and July 25, 1973; and WHEREAS, the City Council, after hearing all evidence and argu- ments regarding said rate request at said public hearing and at the hearing on Central Power and Light Company's Motion for Rehearing, has carefully considered same, and finds that the new rate schedules hereinafter ratified and approved are just and reasonable, will yield a fair return upon the fair value of the Company's property, and are not in excess of those necessary to attract capital and assure confidence in the financial integrity of the Company: 1160$ JRR:jkh:7- 31 -73; 2nd NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY,. OF CORPUS CHRISTI, TEXAS: SECTION 1. That the maximum charges for electricity within said City shall be those set forth in the said Electric Rate Schedules and Terms and Conditions, copies of which are attached hereto and made a part hereof, which Schedules and Terms and Conditions are hereby in all things approved, ratified, confirmed, accepted, and filed in substitution for any and all Electric Rate Schedules and Terms and Conditions heretofore filed by said Central Power and Light Company with this governing body. SECTION 2. The City Council further determines and finds hereby that the charges for electricity shall be subject to adjustment in line with the cost of fuel to Central Power and Light Company, the adjustments in charges to be made in accordance with and as set out in the fuel adjustment clause of each of the said Rate Schedules attached hereto and made a part hereof. SECTION 3. Whenever the average cost of fuel delivered to Central Power and Light Company during the preceding month exceeds thirty -five cents (354) per million BTU, a written statement of such actual average delivered cost of fuel shall be filed with and officially presented to the City Council in open meeting by Central Power and Light Company. At each five cents (54) per million BTU increment thereafter, either increased or decreased, Central Power and Light Company shall file with and officially present to the City Council in open meeting such increase or decrease. On or before January 31 of each year, Central Power and Light Company shall furnish the City a written statement showing the average delivered cost of fuel per million BTU to the Company during the preceding 12 -month period ending December 31, and the resulting accumulated change in rates from the 1972 year base as result of such cost of gas. SECTION 4. It is not intended that the provisions of this ordinance shall in any way restrict or limit the powers of rate regulation by the City, nor constitute a waiver of the right to re- determine the rates applicable within the City at any time, and require the furnishing to the City of such information as the City may deem necessary for the purpose of considering any such re- determination of rates. -2- • r^1 JRR: jkh:7- 31 -73;, 2nd SECTION 5. That all paragraphs after the caption and before the ordaining clause of Ordinance No. 11,392 be and the same are hereby repealed. Further repealed are Sections 1, 2, 3, 6• and.. 8 of said Ordinance No. 11,392. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 7. The charges and Terms and Conditions prescribed in this ordinance shall apply to all electricity used by each customer to whom such charges and Terms and Conditions are applicable, from and after each such customer's first regular meter reading following the effective date of this ordinance. SECTION 8. This ordinance and the terms and conditions contained 137 . herein shall be and become effective from and after t-ise -dasr some'- asaage� vhezecalk ,RAL POWER AND LIGHT COMPANY REQUEST OR CONTRACT FOR SERVICE • CP -1 REV. . • TERMS' AND CONDITIONS GOVERNING ELECTRIC SERVICE All requests for service, except certain government contracts, will be made on the Company's standard request or contract form and accepted by the Company before service is supplied by the Company. The Company may refuse any applicant Indebted to the Company for service rendered at any location until such indebtedness is paid or secured to the satisfaction of the Company. • RATES The rate schedules are on file In each business office, district office, and In the home office of the Company. Copies may be obtained by the Customer on request. Company's rates will be applied in accordance with and subject to the limitations as set out in each rate schedule. The rates charged the Customer will be the Company's standard rate schedule in effect for like conditions of, service to the class of service furnished. If a rate increase or decrease should be made, applicable to the class of service furnished, by the Company or by order or permission of any regulatory body having jurisdiction thereof, such Increased or decreased rates will be applicable to the service rendered from and after the effective date of such rate change. Where it is necessary for the Company to extend its facilities to locations not presently served, or to provide three -phase service to areas not having such services, or to provide service voltages not standard for the area, or where an unusual investment is necessary on the part of the Company due to the character of the Customer's load to be served; the Company reserves the right to require a minimum bill sufficiently large to justify the addition- al investment. OPTIONAL RATES When more than one rate is available, the conditions and circumstances under which each of such rates is available are explained in the published rata schedules, and the selection of one of these rates lies with, and is the responsibility of the Customer. At the request of the Customer, the Company will advise with and explain to Customer the conditions under which each rate is available and its application to the service requirements of Customer, but the Company will not be responsible for any failure of the Customer to select the rate which will continue to be the lowest or most favorable to the Customer and will not be responsible for Customer being served under the most favorable rate at all times. The Company will not make refunds due to the difference, If any, between the amount of charges under a rate selected or agreed upon by a Customer and the amount the charges would have been under any other available rate. Having selected or agreed to a rate, Customer will not be entitled to a different rate available for his service unless and until he requests it in writing and may not change to another available rate within the next twelve- month period unless there is a permanent change In the character or condition of his operations and the service used by him. MONTHLY BILLS Bills for service,will be rendered monthly unless otherwise specified. The terms "month" or "monthly" for billing purposes will mean the period between any two consecutive readings of the meter by the Company, such readings to be taken as near as practicable every thirty days. Monthly bills are due when rendered and are payable upon receipt at Company's business office located nearest to point of delivery of the electric energy. Failure to receive a bill in no way exempts a customer from payment of bills at the provisions of these Terms and Conditions. Bills not paid promptly are in default and service may be discontinued for such default. When the Company is unable to read a meter after reasonable effort, the Customer will be billed at the average of the last three previous monthly bills and the billing will be adjusted when the meter is read. SECURITY FOR PAYMENT OF BILLS AND PERFORMANCE OF OTHER OBLIGATION BY CUSTOMER Upon request by the Company, the Customer will deposit with the Company a sum of money, or other valuable consideration, equal to two average monthly bills for service furnished or to be furnished, as estimated by the Company. This deposit will be security for the payment of bills owing and to become owing and for the performance of all other obligations of the Customer. If the Customer's bills for any two consecutive billing periods of normal operations should exceed appreciably the amount of the security, the Company may require additional security of the Customer by the amount to cover the additional billing. CUSTOMER'S SERVICE. ENTRANCE, METERING, AND TESTING OF METERS If Customer is served by dn overhead distribution system, he will provide a point of connection high enough above ground for the Company to maintdin clearance as required by the National Electrical Safely Code. At a point to be mutually agreed upon, Customer will provide a suitable location on his premises for the installation of meter and other equipment necessary for the Company to deliver power and energy, and to protect Company property from persons not uulhori zed to use, service, cr maintain it. Where a demand meter is needed for computation of bills, the maximum demand as recorded by an approved type meter will be regarded as conclusive unless a test shows the meter in error by more than three percent (3 %) full scale. The amount of energy supplied to the Customer will be determined by means of an Integrating watt -hour meter of standard approved type, and the reading thereof will be conclusive evidence as to the quantity of energy supplied thereunder, unless upon being tested said meter will be found to register inaccurately and its error will exceed two percent (2 %). Demand and /or watt -hour meters will be tested as reasonably necessary, and whenever any test will show meters to be registering in error beyond the limits specified, such meters will be adjusted. Whenever said meters are so adjusted, the readings thereof will be corrected and payment will be made accordingly. If it will be shown by the test that any of the measuring instruments are inaccurate, proper allowance as shown by the test to be necessary will be made to the party entitled thereto, but not for a longer period than thirty (30) days prior to the time when written complaint on inaccuracy Is made. No allowance will be made on any bill on account of claim for Inaccuracy of measurement unless Customer will in writing request such allowance within thirty (30) days from date of bill. MAINTENANCE OF ELECTRICAL EQUIR -0ENT ON CUSTOMER'S PREMISES AND RESPONSIBILITY FOR INJURIES AND DAMAGE THEREFROM Customer will maintain adequate protection equipment in good operating condition on his equipment and otherwise install and maintain his electrical equipment in an entirely safe and efficient manner and in full compliance with all laws and local ordinances and the National Electrical Code and the rules and regulations of the Company In effect at any time. Customer will provide, free of cost to Company, all rights -of -way on and over Customer's premises for the extension and furnishing of service by Company. The duly authorized agents of the Company will have free access at all reasonable hours to the premises of the Customer for the purpose of inspecting wiring, apparatus and equipment, removing the Company's property, reading meters, and for other purposes incident to the furnishing of service. The Company does not assume any duty of inspecting the Customer's wiring, apparatus, 4 machinery, or equipment, and will not be responsible therefor. It is particularly understood that the Customer assume full responsibility for electric energy furnished to him at and past the Point of Delivery described as being the point where the electric energy first leaves the line provided and owned by Company and enters the line provided and /or owned by Customer, and will protect the Company from all claims for injuries and damages to persons and property occurring upon premises of Customer except where it is shown that the negligence of the Company or its agent or agents was the sole proximate cause of such injury or damage. LIMITATIONS OF LIABILITY OF COMPANY FOR INJURIES AND DAMAGE The Company will not be responsible or liable for injuries, and /or damages caused by or resulting from failure to furnish electric energy and service of any kind and amount contracted for, and /or for injuries and damages resulting from the performance or non - performance of any acts by Company connected with the furnishing of energy and service by Company, unless it be shown that the negligence of the Company or its agent or agents was the sole proximate cause of an injury or damage complained of, and under no circumstances will the Company be liable for consequential damages. EXCLUSIVE SERVICE ON INSTALLATION CONNECTED Except in cases where the Customer has a contract with the Company for reserve or auxiliary service, no other source of electricity or power will bo used by the Customer on the same installation in conjunction with the Company's service. LOADS IMPAIRING OTHER CUSTOMER'S SERVICE Certain types of equipment used by Customers have electrical characteristics which may interfere with the service of the Company to its other Customers. In such cases, the Company may decline to serve such equipment under the Company's established rate schedule until the Customer having such equipment has provided at his expense suitable apparatus to hold to reasonable limits the effects of such interference. Some loads may require separate service, and In such event the Company may meter and bill such service separately from other service furnished to the Customer. MOTOR INSTALLATIONS Unless otherwise agreed upon by authorized representatives of the Company and the Customer prior to Installation, all motor Installations will be as follows: (a) All motors of 7 -1/2 horsepower rating or less will be single - phase, unless three -phase service is available at the premises and can be furnished without additional cost to the Company. (b) All motors of more than 7 -1/2 horsepower rating will be three - phase. (c) Company reserves the right to require the installation of (I) reduced voltage starting equipment, and (2) a low voltage release attachment. GASEOUS TUBE LIGHTING DEVICES With the installation of neon Pimps, mercury vapor lamps, fluorescent lamps, or other gaseous cube lamps or lighting devices having low power factor, the Customer may he required to provide, ai his own expense, power factor can ectivo equilnnoei which will maintain the power factor of each such device at not less than ninety percent (90$). AUNT; CAlltf<IT MOD ll Y CENTRAL, POWER AND LIGHT COMPANY SCHEDULE RS -ur -C� 7 -73 ' RESIDENTIAL ELECTRIC SERVICE AVAILABILITY This schedule is available for electric service used for residential purposes in individual private dwellings and in individually metered apartments. Where two housekeeping units are served through one meter, the minimum bill and the kilowatt hour steps other than the water heater block will be doubled for billing purposes. Where more than two housekeeping units or apartments are served through one meter, billing will be on the applicable non - residential rate. TYPE OF SERVICE The electric service furnished hereunder will be single phase, 60 hertz, at the Company's standard secondary voltage. Three phase service will be furnished as provided in Company's published Terms and Conditions Governing Electric Service. Water Heater Specifications water to be is billed I. All single- family dwelling units and all multi - family dwelling units having provisions for individual laundry facilities must have at least one water heater having not less than 40 gallons capacity or must have multiple heaters having a combined capacity of at least 50 gallons. 2. Individually metered mobile homes and multi - family dwelling units without provisions for individual laundry facilities must have at least one water heater having not less than 30 gallons capacity. 3. The heating elements of twin element water heaters will be so controlled that not more than one element can operate at any one time. Section 3 Space Heating Service - Winter Months Only When all electric service used on the premises is supplied through one meter, and when electricity is the sole source of energy for all comfort heating on the premises, and when all electric space heating equipment is permanently installed, the first 500 Kwh used per month will be billed on the rate in Section I, and, during the Winter Months only, all kilowatt hours used in excess of 500 will be billed at 1.204 per kilowatt hour. Section 4 Space Heating Service with Water Heating Service - Winter Months Only I. If kilowatt hours are less than 900, customers will be billed under Section 2. 2. If kilowatt hours are 900 or more, customers will be billed under Section 3. WINTER MONTHS Winter Months as used herein will be the five months service period beginning when meters are read in the October 19th - November 19th meter reading period and ending when meters are read in the March 19th - April 19th meter reading period. Bill dates are from November 26 - April 25, inclusive. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .0033e (50.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. TERMS OF PAYMENT All bills are due when rendered. DETERMINATION OF DEMAND The Customer's maximum demand will be the kilowatt load established by Customer during the 15- minute period of maximum use during the month. In case the Customer has a highly fluctuating load, provision may be made for measuring the demand over a shorter interval or, for use of Customer's connected load instead of measured demand, to determine the Customer's maximum demand for billing purposes. The demand will be measured when Customer's energy consumption exceeds 1,400 kilowatt hours, and /or, when Customer's total connected load exceeds 25 horsepower in motors or other inductive -type equipment. _L CEN1. , POWER AND LIGHT COMPANY SCHEDULE GS -04 -C (Continued) , TERMS OF PAYMENT All bills are due when rendered. This schedule is not available for standby, temporary, or resale service except in conjunction with applicable rider. This schedule is not available where class rates are specified. TYPE OF SERVICE Single or three phase, 60 hertz, service will be supplied at Company's standard secondary voltage. NET MONTHLY RATE Demand Charge $2.10 each for the first 50 kilowatts of maximum demand but not less than $10.50. $1.60 each for all additional kilowatts of maximum demand. Plus an Energy Charge 2.50¢ each for the first 1,000 kilowatt hours 1.95¢ each for the next 4,000 kilowatt hours 1.45¢ each for the next 5,000 kilowatt hours 1.15¢ each for the next 30,000 kilowatt hours 1.034 each for the next 60,000 kilowatt hours 0.92¢ each for the next 200,000 kilowatt hours 0.82¢ each for all additional kilowatt hours used. Minimum Monthly Bill The minimum monthly bill will be the demand charge but not less than $1.00 per horsepower of the largest motor or other inductive -type electric device connected. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .D033¢ ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than twelve cents for that quantity of fuel used containing one million BTU. DETERMINATION OF BILLING DEMAND The Customer's billing demand will be the kilowatt load established by Customer during the 15- minute period of maximum use during the month but not less ihan 5 kilowatts. In case the Customer has a highly fluctuating load, prevision may be made for measuring the kilowatts over a shorter interval or for use of CENTRAL POWER AND LIGHT COMPANY SCHEDULE LP -30 (Continued) Customer's connected Toad instead of measured kilowatts, to determine the Customer's maximum kilowatts for billing purposes. POWER FACTOR CLAUSE The Company reserves the right to make tests from time to time to determine the power factor of the Customer's installation served hereunder. Should the average lagging power factor during the month be determined to be below 80 %, the Customer's kilowatt demand will be adjusted for billing purposes by multiplying the maximum measured kilowatts by 80% and dividing by the average lagging power factor. For determining the lagging power factor, a reactive meter of standard make ratcheted so as to prevent reverse operation will be Installed near the metering point by the Company. PRIMARY VOLTAGE DISCOUNT If the electric service is delivered at primary voltage of the distribution system and if the Customer owns, operates, and maintains all the facilities for receiving such service at delivery voltage, a 5% discount will be made on the energy charge of the rate. TRANSMISSION VOLTAGE DISCOUNT If the electric service is rendered and metered at Transmission Line Voltage (69,000 volts or higher) and if the Customer owns, operates, and maintains all the facilities for receiving such service at delivery voltage, an additional 5% discount will be made on the net kilowatt hour charge remaining after the primary voltage discount has been made. 'METERING VOLTAGE If either primary or transmission voltage is metered on the secondary side of the transformer, 1.5 percent of the metered Kwh will be added to cover transformer losses. TERMS OF PAYMENT All bills are due when rendered. TERNS AND CONDITIONS Service will be furnished under Company's Standard Terms and Conditions Governing Electric Service. ' /CENTRAL POWER AND LIGHT COMPANY SCHEDULE'IP -40 1 -73 INDUSTRIAL POWER AVAILABILITY This schedule is available for primary service on an annual basis where the Customer furnishes, installs and maintains all transformers and distribution facilities from and at a point of delivery to be designated by the Company. The minimum billing demand will be determined by Company based on consideration of Customer's connected load and operating conditions but in no event will the minimum monthly billing demand be less than six hundred (600) kilowatts. Service will be supplied to the entire premises through a single delivery and metering point and at a single voltage. This schedule is not available for standby, temporary, or resale except in conjunction with applicable rider. TYPE OF SERVICE Single or three phase, 60 hertz, service will be supplied at Company's standard primary voltage. NET MONTHLY RATE Demand Charge $960.00 for first 600 kilowatts, or less, of maximum demand. $1.35 each for all additional kilowatts of maximum demand. Plus an Energy Charge 1.68d each for the first 3,000 kilowatt hours 1.18d each for the next 12,000 kilowatt hours 1.08d each for the next 35,000 kilowatt hours 0.88d each for the next 100,000 kilowatt hours 0.78d each for the next 450,000 kilowatt hours 0.68d each for all additional kilowatt hours used. Minimum Monthly Bill The minimum monthly bill will be the demand charge, but not less than the maximum demand charge established during the II preceding months. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .0033d ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds eighteen cents or is less than twelve cents for that quantity of fuel used containing one million BTU. Said separate circuit will be installed by Customer and will be terminated at metering point for Customer's regular service and will be used only to supply service to equipment used for comfort space heating or to an integral all- electric heating and cooling system. Electric service furnished to the space heating circuit will be metered separately from Customer's other service requirements. MONTHLY RATE - DURING WINTER MONTHS 1.450 each for the first 5,000 kilowatt hours supplied to the space heating circuit. 1.206 each for all additional kilowatt hours supplied to the space heating circuit. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. WINTER MONTHS Winter Months, as used herein, will be the five months service period beginning when Customer's meter is read in the October 19 - November 19th meter reading period and ending when meter is read in the March 19th - April 19th meter reading period. Bill dates are from November 26th to April 25th, inclusive. TERMS AND CONDITIONS 'Service furnished under this rider is subject to all provisions of the rate schedule to which it applies, except those provisions which are specifically modified herein. CENTRAL POWER AND LIGHT COMPANY 1 -73 COMMERCIAL HEATING RIDER FOR GREENHOUSES AVAILABILITY This Rider is available under Company's Contract for Electric Service during the Winter Months, to Customers receiving electric service on Company's Combined Lighting and Power Rate Schedule or General Service Rate Schedules who have in regular use, permanently installed for heating purposes in the Greenhouse area, not less than 35 KW of electric heating equipment, provided that electricity is used as the sole heat source in the Greenhouse area. Heating equipment served hereunder will be connected to a separate heating circuit. Said separate circuit will be installed by Customer, and will be terminated at metering point for Customer's regular service, and will be used only to supply service to equipment used for heating the Greenhouse area. MONTHLY RATE During the Winter Months, Customer will be billed on Rate CH -08, Commercial Space Heating Rider. During the Summer Months, any kilowatt hours registered by the meter on the heating circuit will-be added to the registration of the kilowatthour meter on Customer's regular service for billing on rate schedule applicable to Customer's total load. Customer will pay monthly, in addition to his billing for service, an amount equal to 1.67% of the excess investment Company has made to serve Customer's Greenhouse heating load, over that investment Company would have made had no Greenhouse heating equipment been served hereunder. WINTER MONTHS Winter Months, as used herein, will be the five months service period beginning when Customer's meter is read in the October 19th - November 19th meter reading period and ending when meter is read in the March 19th - April 19th meter reading period. The provisions of such rate schedules are modified only as shown herein. DETERMINATION OF BILLING DEMAND During the Winter space- heating season, the total electric service used by Customer will be billed in accordance with the rate schedule io which this rider is applied, except that: Customer's monthly billing demand will be the measured maximum demand for the month or the maximum demand established during the seven months immediately preceding the beginning of the current Winter space - heating season, whichever is higher, reduced by one (I) kilowatt for each rated ton of customer's electric air - conditioning equipment, provided that: Customer's monthly billing demand will not be less than lifty percent (50%) of customer's maximum measured demand for the month or less than fifty percent (50 %) of maximum demand established during said seven month's period. Notwithstanding any provision hereof, the Customer's monthly billing demand will not be more than the measured demand for the month and will not be less than the Customer's minimum billing demand provided for in the service contract to which this rider is applied. The electric air - conditioning connected load will be determined by using standard ratings for cooling as published by American Refrigeration Institute. Where ARI ratings are not published, the certified rating by the manufacturer at the standard design conditions recommended by American Society of Heating, Refrigeration and Air - Conditioning Engineers for the specific location will apply. WINTER SPACE - HEATING SEASON The Winter space-heating season will he the five semiths period beginning when Customer's meter is read in the October 19 to November 19 muter reading period and ending when the meter is read in the March 19 to April 19 meter reading period. RIDER LCH 1 -73 / CENTRAL POWER AND LIGHT COMPANY WATER HEATING SERVICE RIDER FOR SINGLE METER SERVICE UNDER GS, LP, AND IP RATES AVAILABILITY RIDER LWH 1 -73 This Rider is available under Company's Contract for Electric Service furnished through one meter under the Company's General Service (GS), Combined Lighting and Power (LP), and Industrial Power (IP) Rate Schedules to Customers who have twenty -five (25) KW or more of connected load in electric water heating equipment, (except water heating equipment for swimming pools) meeting the requirements specified herein and in regular use supplying Customer's total water heating requirements. The provisions of such rate schedules are modified only as shown herein. DETERMINATION OF BILLING DEMAND The total electric service used by Customer will be billed in accordance with the rate schedule to which this rider is applied, except that Customer's monthly billing demand will be the maximum measured demand for the month reduced by twenty -five (25) percent of Customer's total connected KW in electric water heating equipment (except water heating equipment for swimming pools), provided that: Customer's monthly billing will not be reduced to an amount less than 50% of the maximum demand established during the current month. Notwithstanding any provision hereof, Customer's monthly billing demand will not be less than the Customer's minimum billing demand provided for in the service contract to which this rider is applied. SPECIFICATIONS FOR WATER HEATER INSTALLATIONS SERVED UNDER THIS RIDER I. Total water heating load will be 25 KW or more. 2. The heating elements will not exceed 225 watts per gallon of storage tank capacity. 3. All dwelling units having provisions for individual laundry facilities must have at least one 40 gallon capacity water heater when the dwelling unit is provided with an individual water heater unit. If laundry facilities are not provided for the individual dwelling unit, the water heater size may be reduced to 30, gallon capacity. The capacity of any single dwelling unit heating element will not exceed 6,000 wafts. 4. Only one element of a twin- elornonl heater, such as a water heater having upper and lower elements designed for non- simultaneous operation, will be considered as connected load under this rider. 5. Instantaneous or booster -type equipment will not be considered as connected water heating load under ihis rider. CENTRAL POWER AND LIGHT COMPANY TEMPORARY SERVICE RIDER TS-7 1 -73 AVAILABILITY This Rider is available to customers such as traveling shows, carnivals, fairs, church socials, Christmas lighting, and building contractors requiring service for only a short period of time. This Rider is not available for service to recurring seasonal loads. The Company reserves the right to furnish such service only when proper equipment is available at the location and when the conditions set out in this schedule are met. Where it is necessary to set a meter or to provide any additional facilities, the Customer will be charged with the total cost of installing and removing the equipment, but not less than $5.00. An advance deposit will be required sufficient to cover the estimated consumption for at least a week or for the full duration of the service if less than a week, together with the estimated cost of installing and removing the equipment. BILLING Service will be billed on the appropriate rate schedule. 1. When the Combined Lighting and Power Schedule is applicable, the demand charge will be prorated on a daily basis and the energy will be billed on the steps of the rate without proration. In any case, the minimum charge will not be less than $10.00. 2. When a General Service Schedule is applicable, the energy will be billed on the steps of the rate without proration•. The minimum charge will be determined as provided in the Rate Schedule and will be prorated on a daily basis, but in any case, the minimum charge will not be less than $10.00. CENTRAL POWER AND LIGHT COMPANY STANDBY SERVICE RIDER SS-8 1 -73 AVAILABILITY This rider is available in conjunction with the Company's Electric Rate Schedules on execution by the Customer of Company's Contract for Electric Service for a period of not less than twelve consecutive months and will apply to all electric power and energy supplied by Company to Customers using Company's service as supplementary, reserve, or alternate source of supply in connection with Customer's privately -owned plant or other source of supply. The Company agrees to stand ready to supply Customer at all times during the life of this contract, electric service to the amount of, but not exceeding kilowatts, or if the contract provides for a monthly minimum demand, then not less than the number of kilowatts constituting such monthly minimum demand. If at any time during the life of this contract the Customer should notify Company in writing that he desires to have the Company supply electric service in excess of the amount above stated and the Company should agree to do so, the Company will thereafter stand ready to supply such increased amount. MINIMUM MONTHLY BILL The Customer agrees to pay the Company a net minimum monthly charge hereunder of not less than $2.00 per kilowatt based (a) upon the number of kilowatts that the Company is obliged to stand ready to supply, or (b) upon the number of kilowatts constituting the maximum demand established by the Customer to and including the current month, whichever should be greater. DETERMINATION OF DEMAND The maximum demand will be measured and will be the kilowatt load established by the'Customer during the 15- minute period of maximum use during the current or any preceding month. GENERAL TERMS During any month in which the Customer uses electric power and energy hereunder, billing for such power and energy will be in accordance with the rate schedule attached hereto and made a part of this contract, including minimum charges, demand charges, and energy charges, but in no event will the minimum billing demand be less than of the number of kilowatts Company is obliged to stand ready to supply, or will the minimum monthly bill be less than above provided for in this rider.
