MAKING FINDINGS OF FACT; AMENDING THE CORPUS
��. CHRISTI CITY CODE, 1958, AS AMENDED, AND
PARTICULARLY AS AMENDED BY ORDINANCE 9601,,_
PASSED AND APPROVED JUNE 6, 1970, BY AMENDING
ARTICLE IV, SECTION 9 -49, SUBSECTION (2),
IN "RATES AND RENTAL FEES FOR USE OF SLIPS AND
DOCK SPACE ", FOR THE PURPOSE OF PRESCRIBING
CURRENT AND APPROPRIATE RATES IN SAME; REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; PRO-
VIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE
DATE; AND PROVIDING FOR PUBLICATION.

WHEREAS, in March, 1969, Peat, Marwick and Mitchell
studied the average slip rental rates of the Texas Gulf Coast
marinas and found the average to be 28% higher than the rates
authorized in this Ordinance; and
WHEREAS, recent telephone survey indicates the Texas
average rate of marina slip rentals has increased 10% over the
aforementioned 1969 study; and
WHEREAS, the cost to provide the marina slip services
has increased since the rates were last set in 1970; and
WHEREAS, the City Council finds that an increase in
such slip rental rates is necessary to cope with the rising cost
of such service, to make such service more nearly self - supportive
and thereby avoid a tax increase:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Corpus Christi City Code, 1958, as
amended, and particularly as amended by Ordinance No. 9601, be
and the same is hereby amended by amending Article IV, Section 9 -49,
Subsection (2), "Rates and Rental Fees for use of Slip and Dock
Space ", to hereafter read as follows:
"Article IV
Section 9 -49 Rates arid:,Rental Fees for Use of Slips and Dock Space.
Subsection (2) The rates and rental fees to be charged
for the use of boat slips and boat space in the Corpus Christi
Marina shall be as follows:

(A) There shall be a minimum charge of Fourteen Dollars
($14) per month for each slip or dock space in the Marina.
a (B) Dock space or boat slip shall be payable at the

rate of three cents (3¢) per square foot per month.�� This rate
°'shall be applicable to all slips except the twenty -two (22) slips
located on the south side of the L -head, the rate for which is
fixed in subsection (C) hereof, and for charter boats for rent
or hire, the rate which is fixed in subsection (D))hereof.
(C) The rental for each of the boat slips located on
the south side of the L -head shall be two cents (2¢) per square
foot per month as long as no electricity is provided.
(D) Boat slips used by charter boats shall be charged
at the rate of three cents (3¢) per square foot per month with a
maximum rate of Eighty Dollars ($80) per month unless more than
one owner request to lease the same slip. No electricity will
be provided.
If more than one charter boat owner desires to rent a
particular slip, written notice of such request shall be submitted
to the Marina Superintendent who will set a date at least thirty
(30) days thereafter to receive sealed bids for the monthly
rental of the slip. Such bids will be required to be in excess
of the amount which would otherwise be charged for the slip. The
Cbidder submitting; the highest bid must agree to sign a one -year
lease for the slip and pay three (3) months of the lease in
advance so that at all times, except during the final ninety (90)
days of the lease period, the tenant in any slip obtained will
have paid in advance at least ninety (90) days rent. Such higher
rate shall continue after the end of the one -year le sa period
unless the owner wishes to be released from the additional payment.
At such time bids will again be taken for the slip to determine
the tenant rate which will apply thereafter.
(E) Transient pleasure craft seeking overnight dockage
at the Marina shall pay Two and 50 /100 Dollars ($2.50) per night,
plus fifty cents (50¢) per night for the use of electricity.

3 (F) Transient commercial craft seeking overnight
dockage at the Marina shall pay Ten Dollars ($10) per night with
or without electric service.
All berths and slips shall be assigned by the Marina
Supervisor. No person, specifically including the owner, master,
or operator of any watercraft, shall allow such watercraft to
occupy any berth or slip after the period for which the rents have
been paid has expired. All fees are payable in advance at the
Supervisor's office or at the Collection Section of the Finance
Department.
SECTION 2. All ordinances or parts of ordinances in
conflict herewith shall be and are hereby repealed to the extent
of conflict herewith.
SECTION 3. If for any reason any section, paragraph,
subdivision, clause, phrase, word, or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction it shall not affect any other
section, paragraph, subdivision, clause, phrase, word, or pro-
vision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause,
phrase, word, or provision hereof be given full force and effect
for its purpose.
SECTION 4. This Ordinance shall be effective
September 1, 1973, so that this change is not prohibited by the
provisions of Phase III, economic stabilization program as
announced in Presidential Executive Order No. 11723.
SECTION 5. Publication shall be made in the official
publication of the City of Corpus Christi one time which publica-
tion shall contain the caption, stating in substance the purpose
of the Ordinance.
