HomeMy WebLinkAbout11611 ORD - 08/08/1973JRR:HG:e:7 /25/73 2nd AN ORDINANCE a ► MAKING FINDINGS OF FACT; AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMEND- ING THE TAP FEE SCHEDULE FOR SEWERS IN SEC. 38 -27, ESTABLISHED BY ORDINANCE NO. 4288, PASSED AND APPROVED ON JULY 27, 1955, SO AS TO INCREASE SAID SCHEDULE; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION. WHEREAS, the sewer tap fee schedules established in Sec. 38 -27, Corpus Christi City Code, as amended, were established „wF in 1955 and have not changed since that date; and WHEREAS, the costs to the City of making such taps ; have increased drastically since that date and the City Council has studied those increases; and WHEREAS, the City Council finds that an increase in such tap fee schedule is necessary to cope with the rising costs of making such taps, to make such service more nearly self- supportive and to thereby avoid a tax increase: 7 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF yXgAa' THE CITY OF CORPUS CHRISTI, TEXAS: -tier SECTION 1. That Sec. 38 -27, Corpus Christi City Code, w ` 1958, as amended, be and the same is hereby amended by amending that portion of the first paragraph of said Sec. 38 -27 which reads "House,service line tap charges ", etc., so as to amend the tap fee schedule therein, and only said fee schedule, to read as follows: "House service line tap charges: 4" tap - Street or Easement - - - - - $50.00 6" tap - Street or Easement - - - - - $60.00 8" tap - Street or Easement - - - - - $70.00." SECTION 2. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance r shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or 11611 r $e r provision of this ordinance, for it is the definite intent of :this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. The effective date of the new fee schedule adopted by this Ordinance shall be August 13, 1973, for those taps completed on or after August 13, 1973, the end of Phase III, economic stabilization program as announced in Presidential Executive Order Number 11723. SECTION 5. Publication shall be made in the official publication of the City of Corpus Christi onetime, which publi- cation shall contain the caption, stating in substance the purpose of the Ordinance. 0 That the foregoing ordinance was read for t e first time and passed to its second reading on this the day of , 1973, by the following vote: Jason Luby James T.
