HomeMy WebLinkAbout11614 ORD - 08/08/1973•i Y ' 1 JRR:HG:jkh:7- 25 -73; 1st , T 4 AN ORDINANCE MAKING 'FINDINGS OF FACT' AMENDING THE CORPUS CHRISTI �. s CITY CODE, 1958, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 9883, PASSED AND APPROVED ON AUGUST 12, 1970, BY AMENDING SECTION 38 -46, SO AS TO AMEND THE "INCENTIVE AIR COOLING AND CONDITIONING GENERAL RATE LIMITED TO CUSTOMERS USING LESS THAN 30 MILLION CUBIC FEET PER MONTH ANNUAL AVERAGE" SCHEDULE SO AS TO DELETE THE 22¢ AND 204 STEP THEREIN; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that present gas rates are inadequate to defray the operating expenses and provide a proper return on investment of the City of Corpus Christi in its Gas Distribution System; and WHEREAS, it is the finding of this City Council, after study and deliberation, that the hereinafter ordained gas rates and terms of applicability will probably produce sufficient revenues to the City to defray such operating expenses and gain a proper return of said investment: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi City Code, 1985, as amended, and particularly as amended by ORDINANCE No. 9883, passed and approved on August 12, 1970, be and the same is hereby amended by amending Section 38 -46, so as to amend the "Incentive Air Cooling and Conditioning General Rate Limited to Customers Using Less than 30 million cubic feet per Month Annual Average" Schedule, found on page 3 of said Ordinance No. 9883, so as to delete the 22j and 204 step therein, said schedule to hereafter read as follows: Inside outside City Limits City Limits First 1 MCF per Month @ $2.25 $3.25 Next 2 MCI' per Month @ .85 .85 Next 7 MCF per Month @ .80 .80 Next 40 MCF per Month @ .40 .40 Next 150 MCF per Month @ .35 .35 Next 300 MCF per Month @ .32 .32 Next 500 MCF per Month @ .27 .27 Next 29,000 MCF per Month @ .24 .24 Minimum Monthly Bill 2.25 3.25 The minimum volume used in any month of the year shall m t be less than 50% of the average winter month. SECTION 2. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict. SECTION 3. The effective date of this ordinance shall be for those billings of September 1, 1973, so that this change is not in conflict with the Phase III Economic Stabilization Program as announced in Presidential Executive Order Number 11723. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. -2- E That the foregoing ordinance was read for the first time and passed to its second reading on this the --.r mr.day of, 1973, by the following vote: Jason Luby, James T.
