HomeMy WebLinkAbout11635 ORD - 08/15/1973JRR:HG:hb 8/15/73 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH LO -VACA GATHERING COMPANY AND SOUTHERN COMMUNITY GAS COMPANY PROVIDING FOR THE RELOCATION OF CERTAIN PIPELINE FACILITIES NECESSARY PRIOR TO CONSTRUCTION OF THE CLARK - WOOD DRAINAGE DITCH ALL AS IS MORE FULLY SET FORTH IN A COPY OF SAID AGREEMENT ATTACHED HERETO, MARKED EXHIBIT "A" AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND $20,000 WHICH AMOUNT IS TO BE TRANSFERRED FROM NO. 121 GENERAL REVENUE SHARING FUND, ACTIVITY 5681, CODE 501; OF SAID APPROPRIATION $16,900 IS FOR THE ADJUSTMENTS TO BE DONE BY LO -VACA GATHERING COMPANY, $2,388.23 IS FOR THE ADJUSTMENTS TO BE DONE BY SOUTHERN COMMUNITY GAS COMPANY, AND $711.77 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Lo -Vaca Gathering Company and Southern Community Gas Company providing for the relocation of certain pipeline facilities necessary prior to construction of the Clarkwood Drainage Ditch, all as is set forth in said agreement, a copy of which is attached hereto, marked Exhibit "A ", and made a part hereof for all pertinent purposes. SECTION 2. That there is hereby appropriated out of No. 295 Storm Sewer Bond Fund $20,000, which amount is to be transferred from No. 121 General Revenue Sharing Fund, Activity 5681, Code 501. Of said appropriation $16,900 is for the adjustments to be done by Lo -Vaca Gathering Company, $2,388.23 is for the adjustments to be done by Southern Community Gas Company, and $711.77 is for contingencies and incidental expenses. SECTION 3. That the necessity to authorize the execution of the aforesaid agreement, for and on behalf of the City of Corpus Christi, so that the necessary relocation '. LC-35 of pipeline facilities may be accomplished and the construction of the Clarkwood Drainage Ditch may proceed, creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect-from and after its passage (and publication), IT IS ACCORDINGLY SO ORDAINED, this the_Lrday of , 19 7-1. ATTEST: rx City SedriitAry APPROVED: DAY OF AUGUST, 1973: 1 a � MAY THE CITY OF CORPUS CHRISTI, ERAS JRR:HG:hb 8/14/73 AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES X This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas, a municipal corporation and body politic operating under the home rule statute of the State of Texas, hereinafter called "City ", Lo -Vaca Gathering Company and Southern Community Gas Company, herein called "Operators" and pertains to the construction of the Clarkwood Ditch, a joint City -State project within the city limits of Corpus Christi, and relocation of existing utilities crossing the Clarkwood Ditch existing in right -of -way being acquired by the City for the Clarkwood Ditch drainage project. W I T N E S S E T H WHEREAS, Operators have been requested by the City to adjust their existing facilities for the future excavation of the Clarkwood Ditch in the joint City -State drainage project; and WHEREAS, Operators and the City have determined a safe and reasonable means of adjusting said facilities; and WHEREAS, the City has agreed to reimburse Operators for applicable expenses incurred in providing said protection; NOW, THEREFORE, the City and Operators agree as follows: 1. Lo -Vaca Gathering Company, a subsidiary of Coastal States Gas Producing Company will relocate facilities they operate immediately south of Highway 44 known as Clarkwood Compressor Facilities. Said relocation will consist of the re- location of 4" and 10" pipelines, separators, cathodic protection equipment and other appurtenances, and construction of new facilities as shown on attached Exhibit A. 2. Southern Community Gas Company will relocate certain facilities also in the area of the Clarkwood Facilities. This relocation will consist of the abandonment of 2" - 2 -1/2" and 4" diameter gas lines and the placing of new lines and facil- ities as shown on the attached Exhibit A. 3. Both Operators agree to begin the relocation of facilities covered by the agreement no later than November 1, 1973 and to commence this work to expeditious completion. 4. The City will pay both Operators for this work, which may be done by Operators maintenance forces, in accordance with the statement of work attached hereto by both Operators and made a part of this agreement, said payment being estimated as follows LO -VACA GATHERING COMPANY $16,900.00 SOUTHERN COMMUNITY GAS CO. $ 2,388.23 5. The City will provide inspectional services for purposes of tabulating material, labor, and equipment costs incurred by Operators. 6. The City will arrange for staking control of the work for horizontal and vertical alignment. 7. Both Operators agree to indemnify and hold harmless the City from any and all claims, suits or liability of any kind whatsoever from the work performed by them under this agreement and agrees to perform all work in a good work- manlike manner. 8. This agreement shall be executed in three (3) copies, each of which shall be considered an original, and shall become effective and be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and assigns. -2- WITNESS OUR HANDS this �� -9 _day of #1973.
