HomeMy WebLinkAbout11638 ORD - 08/15/1973AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH MRS. T. M. GANNAWAY FOR THE LEASING OF A BUILDING LOCATED AT 2525 AGNES STREET IN THE CITY OF CORPUS CHRISTI FOR A TERM OF TWELVE (12) MONTHS AT A RATE OF $480 PER MONTH FOR USE AS A MULTIPURPOSE FACILITY IN THE CITY'S SENIOR CITIZENS ASSISTANCE PROGRAM. A COPY OF WHICH LEASE AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is here- by authorized to execute a lease agreement with Mrs. T. M. *Gannaway for the leasing of a building located at 2525 Agnes Street in the-City of Corpus Christi, for a term of twelve months at a rate of $480 per month, for use as a multipurpose facility in the City's Senior Citizens Assistance Program, a copy of which lease agreement is attached hereto and made a part hereof for all pertinent purposes. SECTION 2. The necessity to authorize the execution of the aforesaid lease agreement, for and on behalf of the City of Corpus Christi, so that the City's Senior Citizens Assistance Program may be provided with a building from which to conduct its operations, creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage : �±Mpl 1 • it is ACCORDINGLY SO ORDAINED, this the�day of_ 1973. D. 1973 by and between Mrs. T.M. Gannaway, known herein as LESSOR, and The City of Corpus Christi, Texas, known herein as LESSEE. (The terms "Lessor" and "Lessee" shall be construed in the singular or plural number according as they respectively represent one or more than one person.) WITNESSETH, That the said Lessor does by these presents lease and demise unto the said Lessee the following described prop- erty, to -wit: Lying and being situated in Corpus Christi, County of Nueces, State of Texas, and being: The building and land known as 2525 Agnes St., namely the West 20' of Lot 12 and Lot 13, 14, 15, in Block 6, Steele, together with building located thereon and accompanying parking spaces. This property is leased on an "as is - where is" basis and Lessor shall be responsible only for the roof, and for maintenance of the heating and air conditioning equipment, as well as plumbing, except as caused by Lessee's negligence. All utilities shall be paid by Lessee. Lessee may make such renovation, alteration, or improvement it deems fit for the recreation activity, provided that any such of a structural or major nature, written accord shall be had with the Lessor. For the term of one (1) year beginning the first day of September A.D. 1973 and ending the 31st day of August A.D. 1974 paying therefor the sum of Five Thousand Seven Hundred Sixty ($5,760) dollars, payable in monthly installments of $480, payable on or before the first day of each month by mailing to 333 Cole St., Corpus Christi, Texas 78404, upon the conditions and covenants following: First. That Lessee will well and PUNCTUALLY pay said rents in manner and form as hereinbefore specified and quietly deliver up said premises on the day of the expiration of this lease, in as good condition as the same were in when received, reasonable wear and tear thereof excepted. Second. That the said premises shall be used for a multipurpose center for the City's Senior Citizens Assistance Pro- gram. Third. That Lessee will not sub -let said premises, or any part thereof, to any person or persons whatsoever, without the consent of said Lessor, IN WRITING, thereto first obtained. Fourth. That on failure to pay the rent in advance, as aforesaid, or comply with any of the foregoing obligations, or in violation of any of the foregoing covenants, the Lessor may declare this lease forfeited at her discretion and her agent or attorney shall have the power to enter and hold, occupy and repossess the entire premises hereinbefore described, as before the execution of these presents. Fifth. Lessee has the right to renew this lease for three (3) additional one (1) year periods, with thirty (30) day prior written notice to Lessor, at the same rate as the first year rate. Sixth. Lessee may cancel this lease by giving the other party sixty (60) days written notice.
