HomeMy WebLinkAbout11658 ORD - 08/22/1973•JRR:RWC:e:8/21/73 +, • 1st AN ORDINANCE CLOSING THE STREET RIGHT OF WAY AREAS ABUTTING OR LYING WITHIN LOT 25, SECTION 54, FLOUR BLUFF AND ENCINAL FARM & GARDEN TRACTS, AND LOT 21- D,GLENOAR SUBDIVISION; AND DECLARING AN EMERGENCY, WHEREAS, notice of the time and place for holding a hearing concerning the closing of certain street right of way abutting or lying within Lot 25, Section 54, Flour Bluff & Encival Farm & Garden Tracts, and Lot 21 -D, Glenoak Subdivision, in the City of Corpus Christi, Nueces County, Texas, was given by publication and registered mail to the last known addresses of-the owners of property abutting said street and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, July 18, 1973, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the street within the limits hereinabove set forth: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That those certain portions of street right of way lying within or abutting Lot 25, Section 54, Flour Bluff & Encinal Farm & Garden Tracts, and Lot 21 -D, Glenoak Subdivision, in the City of Corpus Christi, Nueces County, Texas, as shown on the map attached hereto, marked Exhibit 'W', and made a part hereof, be and the same are hereby closed for public use and abandoned to the owners of the abutting property. SECTION 2. If for any reason any section, paragraph, subdivi- sion, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect. 111 G58 SECTION 3. The necessity to abandon the hereinabove described street right of way so that orderly development of the area may proceed creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall br passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council and the Mayor having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordi- nance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY 50 ORDAINED, this the day of August, 1973. ' w J • J.a.1a1n GLc I e E H W H rA Corpus Christi, Texas • day of , 19-u TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
