HomeMy WebLinkAbout11665 ORD - 08/23/1973JRR:RWC:e:8 /23/73. 1st AN ORDINANCE AMUIDING THE Z014ING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FRaH TIME TO TII-'.E AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, UPON APPLICATION OF Saratoga Land Company BY AMENDING THE ZONING MAP DY CHANGING THE Z0111ING ON AN .86 ACRE TRACT OF LAND FROM "R -18" ONE- FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT, AND ON A 2.05 ACRE TRACT OF LAND FROM "R -1B" ONE- FAMILY DWELLING DISTRICT TO "R -2" TWO - FAMILY DWELLING DISTRICT, BOTH TRACTS BEING OUT OF LOTS 3 AND 4, SECTION 5, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EKISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF Saratoga Land Company FOR AMENDMENT TO THE ZONING 14AP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON Thursday, August 23, 1973 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED-AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY of CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,'Or THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. X665 SECTION 2. That the zoning on the following described tract, designated as "TRACT A ",be and the same is hereby changed from "R -1B" One- Family Dwelling District to "AB" Professional Office District, said Tract A being described as follows: An .86 acre tract of land (more or less) situated in Lots 3 and 4, Section 5, Flour Bluff and Encinal Farm and Garden Tracts in Nueces County, Texas: BEGINNING at the northeast corner of Lot 1, Block 4 of the Country Club Estates Unit 19 as shown by map recorded in Volume 39, page 71, of the Map Records of said County for the northwest corner and POINT OF BEGINNING of this tract; THENCE with the easterly boundary line of Lot 1 S. 28° 54' 15" W. 311.45 feet to the southeast corner of Lot 1 and the southwest corner of this tract; THENCE S. 610 05' 45" E. 120 feet to the southeast corner of this tract; THENCE N. 280 54' 15" E. 311.45 feet to the southerly right of way line of Saratoga Boulevard for the north- east corner of this tract; THENCE with said right of way line N. 61° 05' 45" W. 120 feet to the POINT OF BEGINNING; and that the zoning on the following described tract, designated as "TRACT B ", be and the same is hereby changed from "R -1B" One Family Dwelling District to "R -2" Two Family Dwelling District, said Tract B being described as follows: A 2.05 acre tract of land (more or less) situated in Lots 3 and 4. Section 5, Flour Bluff and Encinal Farm and Garden Tracts in Nueces County, Texas: BEGINNING at the northeast corner of Country Club Estates Villa Unit 2 as recorded in Volume 39, Page 69 of the lisp Records of said County for the northwest corner and POINT OF BEGINNING of this tract; THENCE S. 28° 54' 15" W. with the east boundary line of Country Club Estates Villa Unit 2 53.55 feet to the point of curve of a circular curve to the left; THENCE with said curve whose central angle = 20° 45' 17 ", radius = 559.56', tangent = 102.47' for an arc distance of 202.69 feet to the point of tangency; THENCE S. 8° 08' 58" W. at 65' pass the northeast corner of Country Club Estates Villa Unit 1 as shown by map recorded in Volume 39, Page 67 of said map records and continuing with the east boundary line of Country Club Estates Villa Unit 1 173.59 feet for a total distance of 238.59 feet to the point of curve of a circular curve to the left; -2- THENCE with said curve whose central angle = 46° 01' 2111, radius -.396.74', tangent = 168.50' for an are distance of 318.68 feet to the southwest corner of this tract; THENCE N. 520 07' 37" E. 120 feet to the southeast corner of this tract; THENCE in a northwesterly to northeasterly direction with a circular curve to the right whose radius center bears N. 520 07' 37" E. 276.74 feet, said curve having a central angle = 46° O1' 21 ", tangent = 117.53' for an are distance of 222.29 feet to the point of tangency; THENCE N. 8° 08' 58" E. 238.59' to the point of curve of a circular curve to the right ;. THENCE with said curve whose central angle = 20° 45' 1711, radius = 439.56', tangent = 80.49' for an arc distance of 159.22' to the point of tangency; THENCE N. 28° 54' 15" E. 53.55' to the northeast corner of this tract; THENCE N. 61° 05' 45" W. 120 feet to the POINT OF BEGINNING. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, DE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 11. THAT THE Z014ING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS A14ENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY DF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND At: IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THt DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF 147-3 ATTEST• iC l CITY SECRETARY /� APPROV D: . I I I Corpus Christi, Texas day of TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
