HomeMy WebLinkAbout11682 ORD - 09/05/1973JRR :vp :9/4/73:1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT WITH BEULAH MAHAN BAKER, A WIDOW, AND THEM SMITH, A WIDOW, FOR THE ACQUISITION OF PARCEL N0. 49, OSO SMIAGE DISPOSAL PLANT EXPANSION PROJECT; APPROPRIATING $243,456.65 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, OF WHICH $134,475 IS TO BE TRANS- FERRED FROM NO. 121 GENERAL REVENUE SHARING FUND, ACTIVITY 5621, CODE 501, TO SUPPLEMENT $108,981.65 CURRENTLY ALLOCATED TO PROJECT NO. 25o -61 -25.5; OF SAID APPROPRIATION $242,375 IS FOR PURCHASE AT THE APPROVED VALUE AND $1,081.65 IS FOR INCIDENTAL COSTS RELATED TO THE CLOSING OF THE PURCHASE OF THE AFORE- SAID PARCEL; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized and directed to execute a real estate sales contract with Beulah Mahan Baker, a widow, and Thelma Smith, a widow, for the acquisition of 'Parcel No. 49, Oso Sewage Disposal Plant Expansion Project, Project No. 250 -61 -25.5, said parcel being hereinafter more fully described as follows: Field notes of a survey of 36.95 acres of land made for the City of Corpus Christi, Nueces County, Texas. Said survey is situated in Nueces County, Texas, and is out of the southwest part of Lots 9, 10 and 11, Section 17 of the Flour Bluff and Encinal Farm and Garden Tracts as shorn by map of record in Volume A, Pages 41 -43 of .the map records of Nueces County, Texas. Said survey is more particularly described by the following metes and bounds: Beginning at a point for the northwest corner of Lot 16, Section 17 and the southwest corner of Lot 11 Section 17 of the.Flour Bluff and Encinal Farm and Garden Tracts. Being also the northwest corner of Lot 1, Block 26, of the Pharaoh Valley North Unit 2 as shown by map of record in Volume 32 Page 72 of the Map Records of Nueces County Texas, for the southwest corner of this survey: Thence N. 28 0 58' 20" E. 820 feet to the southwest corner of a 47.34 acre tract of land in the name of the City of Corpus Christi for the Oso Sewage Disposal Plant Site for the Northwest corner of this survey, Thence S. 60 57' 20" E. at approximately 660 feet pass the boundary line between Lot 10 and Lot 11, at approximately 1320'feet pass the boundary line between Lot 9 and Lot 10 and at 1945.75 feet to a point on the northwest line of Nile Drive for the northeast corner of this survey; Thence S. 290 01' 10" W. 190.64 feet with the northwest line of Nile Drive to a point for an interior corner of this survey; Thence S. 60 58' 50" E. 20 feet to a point for an,anterior corner of this survey; Thence continuing S. 290 O1' 10" W. with the northwest line of Nile Drive 629.36 feet to a point for the southeast corner of this survey from which point the Northeast corner of Lot 18, Section 17 of the said Flour Stuff and Encinal Farm and Garden Tracts bears S. 600 571 20" E. 20 feet; 1662 Thence N.. 60 57' 20" W. with the northeast boundary line of Pharaoh Valley North Units 1 and 2 at 10 feet pass the northeast corner of Lot 6, Block 23 of the said Pharaoh Valley North Unit 1, at 1032.14 feet pass the northwest corner of Lot 17, Block 23 and at 1964.95 feet in all to the Place of beginning and containing 36.95 acres of land more or less. SECTION 2. There is hereby appropriated out of the No. 250 Sanitary Sewer Bond Fund the sum of $243,456.65, of which $134,475 is to be transferred from the No. 121 General Revenue Sharing Fund, Activity 5621, Code 501, to supplement $108,981.65 currently allocated to Project No. 250- 61 -25.5; of said appropriation $242,375 is for purchase at the approved value and $1,081.65 is for incidental costs related to the closing of the purchase of the aforementioned parcel. SECTION 3. The necessity to authorize the aforesaid contract and appropriation of the necessary sums creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of September, 1973. SO , �9 Director of nce FIN 2 -55 Revised 7/31/69 Corpus Christi, Texas = day of 19-U TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
