HomeMy WebLinkAbout11688 ORD - 09/12/1973JRR:jkh:cd :9 -10 -73 AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND $2,850 TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 10784, DATED APRIL 5, 1972, TO ACQUIRE PARCEL NO. 12, SOUTH STAPLES STREET- PADRE ISLAND DRIVE TO SARATOGA BOULEVARD PROJECT, NO. 220 -70 -107, FROM THE OWNERS, WILBERT HERMIS AND WIFE, DAISY MARIE HERMIS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $2,850 to supplement funds previously appropriated for this parcel by Ordinance No. 10784. SECTION 2. That the City Manager be, and he is hereby, authorized to execute a real estate sales contract with Wilbert Hermis and wife, Daisy Marie Hermis, for the acquisition of Parcel No. 12 of the South Staples Street Project from Padre Island Drive to Saratoga Boulevard, Project No. 220 -70 -107, said parcel being described as follows: Being a 10 foot wide strip of land parallel to and abutting South Staples Street out of Lots 20 & 21, Block 5, Gardendale No. 2 as recorded in Vol. 8, Page 38, Map Records of Nueces County, Texas and more particularly described by metes and bounds as follows: Beginning at the most Southerly corner of said Lot 21; Thence N. 610 00' 40" W. along the Southwest boundary line of said Lot 21 a distance of 20 feet to a point, the P. C. of a circular curve; Thence in a Northeasterly direction with the arc of a curve to the left whose central angle is 890 59'20 ", Radius 10 feet, Tangent 10 feet, and length 15.71 feet to a point, the P. T. of the curve; Thence N. 290 E. parallel to and 40 feet from the original centerline of South Staples Street a distance of 190 feet'to a point in the Northeast boundary line of said Lot 20; Thence S 610 00' 40" E. with the Northeast boundary line of said Lot 20 a distance of 10 feet to a point in the existing Right -of -Way of South Staples Street; Thence S. 290 W. with the existing Northwest Right -of -Way line of South Staples Street a distance of 200 feet to the point of beginning and containing 2021.4 square feet of land more or less. SECTION 3. The necessity to authorize the execution of the necessary documents and to authorize the payment of funds for the acquisition of the aforesaid parcel of land in order to proceed with the development of the South Staples Street Project, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, the the /Z_Z;U day of September, 1973.
