HomeMy WebLinkAbout11693 ORD - 09/12/1973• JRR:HG:jkh:9- 12 -73; let • AN ORDINANCE RATIFYING AN AMENDMENT TO THE GRANT AGREEMENT HERE- TOFORE ENTERED INTO BETWEEN THE FEDERAL AVIATION ADMINISTRATION AND THE CITY OF CORPUS CHRISTI BY AUTHORITY OF ORDINANCE NO. 9482, PASSED AND APPROVED BY THE CITY COUNCIL ON SEPTEMBER 10, 1969, BY DELETING PARAGRAPHS 9 (h) AND 10 FROM THE SAID GRANT AGREEMENT, APPLICABLE TO PROJECT NO. 9- 41- 156 -7008, CORPUS CHRISTI INTERNATIONAL AIRPORT, AS MORE FULLY SET FORTH HEREIN- AFTER; AND DECLARING AN EMERGENCY. WHEREAS, the Federal Aviation Administration has tendered an Amendment to the Grant Agreement for Project Number 9-41 -156 -7008 to the City of Corpus Christi thereby deleting from the Grant Agreement paragraphs 9 (h), rAlating to relocation of FM 763 traversing the southeast clear zone as shown on the Airport Layout Plan for the International Airport, to a location satisfactory to the Administrator of the FAA, the relocation'of the road not being necessary for proper operation of the navigation aide at the Airport, and deleting paragraph 10 of the aforesaid Grant Agreement so as to allow the City and FAA to close out the Project promptly, conditioned upon the City of Corpus Christi accepting such amendment, a copy of which is attached hereto and incorporated by reference as if set out fully herein; and WHEREAS, by Ordinance adopted March 28, 1973 by the City Council of the City of Corpus Christi, the City of Corpus Christi did accept said Amendment No. 1 to Grant Agreement, but inadvertently did not specifically authorize the Mayor or the City Manager of the City of Corpus Christi to evidence such acceptance by affixing his signature thereto and did not speci- fically declare that a copy of the amendment was attached to, incorporated into and made a part of said Ordinance as required by the Federal Aviation Regulations; and WHEREAS, the Mayor of the City of Corpus Christi did formally evidence said acceptance by affixing his signature to said Amendment; and WHEREAS, the City of Corpus Christi is desirous of ratifying said acceptance and otherwise complying with the requirements of the Federal Aviation Regulations: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 11693 SECTION 1. That Amendment No. 1 to Grant Agreement for Project No. 9- 41- 156 -7008, Corpus Christi International Airport, Corpus Christi, Texas, be and it is accepted by the.City of Corpus Christi and the City Manager, R. Marvin Townsend, is authorized to execute said Amendment No. 1, nunc pro tunc March 25, 1973. SECTION 2. That the execution of the attached Amendment No. 1 to FAA Project No. 9- 41- 156 -7008 by the City Manager, R. Marvin Townsend, on IJ ]� the 2f day of MsteW, 1973, is hereby ratified, confirmed and approved in C y` all respects. SECTION 3. That the City Secretary be and is hereby authorized and directed to forward certified copies of this ordinance to the Federal Aviation Administration together with the executed Amendment No. 1 to Grant Agreement for Project No. 9 -41- 156 -7008. SECTION 4. The necessity to immediately ratify an amendment to the Grant Agreement heretofore entered into between the Federal Aviation Administration and the City of Corpus Christi by authority of Ordinance No. 9482, as hereinabove more fully set forth, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and having requested that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after.its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1Z ay of September, 1973. Texas grolect No. 9 -41 -156 -7008 Contract No. DOT- FA70 -SW -5001 AIiNN MEET NO. 1 TO GRANT AGREEMENT WHEREAS, the Chief, Houston Airports District Office of the Federal Aviation Administration, has determined it to be in the interest of the United States of America that the Grant Agreement between the Acting Area Manager, Houston Area Office of the Federal `viation Agency, acting for and on behalf of the United States, and the City Manager, acting for the City of Corpus Christi, i State of Texas, under date of 10 September 1969 relating to the Corpus Christi International Airport, Project No. 9-41- 156 -7008 be amended as hereinafter provided. W9 THEREFORE, WITNF.SSETH: That in consideration of the benefits to accrue to the parties hereto, the United States of America on the one part, and the City of Corpus Christi (hereafter referred to as "Sponsor") on the other part, do hereby mutually agree that the said Grant Agreement shall be and hereby is amended as follows: 1. Paragraphs No. 9(h) and 10 of the Grant Agreement appearing on page 6 are as follows: 9(h) The Sponsor aggress to relocate within a reasonable time but in any event prior to final payment under this Grant Agreement, the PM Road 763 travetsing the southeast clear zone as shown on the Airport Layout Plan for this airport, to a location satisfactory to the Administrator. 10.
