AN ORDINANCE
ABANDONING THE UTILITY EASEMENT RESERVED BY
ORDINANCE NO. 10535, AS AMENDED BY ORDINANCE
NO. 11380, SAVE AND EXCEPT A 30 -FOOT DRAINAGE
EASEMENT, HEREINAFTER MORE FULLY DESCRIBED,
WHICH IS RETAINED BY THE CITY; PROVIDING FOR
SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, Ordinance No. 10535, passed and approved by
the City Council on the 27th day of October, 1971, closed a
portion of Moore Street and set forth certain conditions; and
WHEREAS, Ordinance No. 11380, passed and approved by
the City Council on the 21st day of March, 1973, amended said
Ordinance No. 10535 in certain respects; and
WHEREAS, it has now been determined that all of said
easement formerly retained for utility purposes by said Ordinances
is not now needed and should be abandoned, save and except a
30 -foot easement for drainage purposes, which is to be retained:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the utility easement heretofore
retained by the City in Ordinance No. 10535, which closed a portion
of Moore Street, as amended by Ordinance No. 11380, be and the same
is hereby abandoned, save and except there is hereby retained a
30 -foot easement for drainage purposes, which is described as
follows:
Being a rectangular shaped tract of land out of
the east portion of Moore Street as closed by
City Ordinance No. 10535, as amended by Ordinance
No. 11380, and lying west of and adjacent to the
Missouri Pacific Railroad right of way, said tract
of land being more particularly described by metes
and bounds:
Beginning at a point, the southeast corner of Block 7,
John G. Hatch Addition, as shown by map of record in
Volume A, page 4, Map Records, Nueces County, Texas,
and in the west right of way line of said railroad
for the northeast and beginning corner of the tract
herein described;
Thence S. 30° 30' W., with the west right of way line
of said railroad, a distance of 50.0 feet to the north-
east corner of Block 8, said John G. Hatch addition for
the southeast corner of the tract herein described;

Thence N. 590 30' W., with the north line of said
Block 8, a distance of 30.0 feet to a point for the
southwest corner of the tract herein described;
Thence N. 300 30' E., a distance of 50.0 feet to a
point in the south line of said Block 7, for the
northwest corner of the tract herein described;
Thence S. 590 30' E., with the south line of said
Block 7, a distance of 30.0 feet to the point of
beginning;
Containing 1500 square feet of land more or less.
All other provisions and conditions of said Ordinance No. 10535
as amended by Ordinance No. 11380, shall remain in full force and
effect.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word, or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction it shall not affect any other
section, paragraph, subdidivion, clause, phrase, word, or pro-
vision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause,
phrase, word, or provision hereof be given full force and effect
for its purpose.
SECTION 3. The need to abandon the aforesaid portion
of said easement at the earliest possible date creates a public
emergency and an imperative public necessity requiring the suspen-
sion of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction and that such ordi-
nance or resolution shall be read at three several meetings of the
City Council, and the Mayor, having declared such emergency and
necessity to exist, having requested the suspension of said Charter
rule and that this ordinance be passed finally on the date of its
introduction and that such ordinance take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the 1.2-ZX day of September, 1973.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
