AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH MAVERICK ENGINEERING COMPANY FOR THE PREPARA-
TION OF A UTILITIES MASTER PLAN FOR CORPUS CHRISTI
BEACH AREA, AS MORE FULLY SET FORTE IN THE CONTRACT,
A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT
"A ", AND MADE A PART HEREOF; APPROPRIATING $33,600,
OF WHICH $14,489 IS OUT OF NO. 295 STORM SEWER BOND
FUND, APPLICABLE TO PROJECT NO. 295- 72 -12; $1o,636
IS OUT OF NO. 250 SANITARY SEWER BOND FUND, APPLI-
CABLE TO PROJECT NO. 250 -70 -102; AND $8,475 Is OUT
OF NO. 202 WATER BOND FUND, APPLICABLE TO PROJECT
NO. 202- 68 -35; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
and directed to execute, for and on behalf of the City of Corpus Christi,
a contract with Maverick Engineering Company for the preparation of a
utilities Master Plan for Corpus Christi Beach Area, as more fully set forth
in the contract, a copy of which is attached hereto, marked Exhibit "A ",
and made a pest hereof.
SECTION 2. There is hereby appropriated $33,600, of which $14,489
is out of No. 295 Storm Sever Bond Fund, applicable to Project No. 295- 72 -12;
$10,636 is out of No. 250 Sanitary Sewer Bond Fund, applicable to Project
No. 250 -70 -102; and $8,475 is out of No. 202 Water Bond Fund, applicable
to Project No. 202- 68 -35.
SECTION 3. The necessity to immediately enter into a contract with
Maverick Engineering Company for the projects as outlined above creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter role that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Chester rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and

effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the

CONTRACT FOR ENGINEERING SERVICES

The City of Corpus Christi, a municipal corporation and body politic,
operating under the home rule charter of the State of Texas, hereinafter called
"City ", and Maverick Engineering Company, hereinafter called "Engineer ", whether one
or more, agree as follows:
1. Services to be Performed by Engineer
A. General Scope of Work The Engineer hereby agrees, at his own
expense, to perform all engineering services necessary to properly
develop a comprehensive Master Plan for water, sanitary sewer
and drainage at the Corpus Christi Beach area of the City of
Carpus Christi. The services shall include the preparation
of preliminary plans to be bound into a formal report including
all three areas, water, sanitary sewer and drainage. The area
known as Corpus Christi Beach is bound by Nueces Causeway to
the north, Corpus Christi Ship Channel to the south, Corpus
Christi Bay to the east and City Limit lineL.to the west.
B. Scope of Services The Engineer's services included in the gen-
eral scope will be as follows:
1) Provide all necessary field work and or aerial photography
required for the study.
2) Review all existing utility systems on the beach to deter-
mine their capacity and capability for future use.
3) Review of existing and proposed future land use and deter-
mine from such land use the ultimate needs from the stand-
point of water, sewer and drainage.
4) Review of the City's plans for expansion on the Park at
the north end and its effect on the water, sewer and drain-
age.
5) The report shall consider the use of Timon Parkway for rec-
reational. use.
6) Review and coordinate the proposed Master Plan with the
U. S. Corps of Engineers in order for the plan to take in
fall consideration of the beach expansion and the impact
to the plans.
7) Coordinate all work with all City, State and Federal
agencies involved.
8) Provide a summary of beat materials to be used in the im-
plementation of the comprehensive plan.
9) Provide any subsurface investigation needed in order to
develop the comprehensive plan.
C. Comprehensive Plan Details The final plans shall be in bound
form and sball include, but not limited to the following:
1) A discussion of the beach environment
2) Population studies and projection
3) Design criteria used for water, sewer and drainage
4) Discussion of the Beach enlargement and effect
5) Topographic physical features
6) Subsurface features
7) Recommendations reference the water, sewer and drainage
comprehensive plan
8) Alternate plan and discussion
9) Cost estimate for each plan and future projection
10) Phase construction of plan and its effect on development
11) Preliminary plans to enough detail to be used for designs
in future without additional preliminary work
12) Provide 50 bound copies of the comprehensive plan to City
13) Provide all other general . or detail work necessary for the
completion of the plan
14) Coordinate the work at all times through the office of the
Director of Engineering & Physical Development
15) The City will furnish the Engineer all information available
to the City in regard to the existing utilities future plans
and all other intergovernmental information about the pro-
ject.
2. Fee
For all services listed above in Items 1 A -B-C, the City will pay
the Engineer a fee of $33,600.00 to be paid as follows:
1) Monthly rate not to exceed $6,000.00/monthly for the first
four (4) months of the project upon the submission of a pro-
gress report by the Engineer stating the amount of work per-
formed and money spent on the project
2) $9,600•00 or the total amount remaining on the project upon
completion of the comprehensive plan by the City.
Should the City desire to receive the services of the Engineer to
implement any of the new recommendations of the plan through the
design and construction phase, the fee for such services shall be
based on the appropriate curve and percentage as recommended by
the latest "Manual of Practice for Engaging the Services of a
Consulting Engineer" as published by the Texas Society of
Professional Engineers, except that the recommended percentage
shall be reduced by 25% of the rate to reflect credit to the City
for preliminary work performed under this contract.
3. Time of Completion
The Engineer agrees to have the Master Plan completed within 150
calendar days from the day of authorization to proceed.
4. Termination of Contract
The City may at any time, with or without cause, terminate this
contract. In the event termination occurs the Engineer shall be
compensated for his service on the basis of actual work performed
up to the day of termination and upon delivery of all work com-
pleted to the City.
5• Assignability
The Engineer shall not assign, transfer or delegate any of his
obligations or duties in this contract to any other person with-
out the prior written consent of the City, except for routine
duties delegated to personnel of the Engineer's staff. If the
Engineer is a partnership, in the event of the termination of the
partnership, this contract shall inure to the individual benefit
of such partner or partners as the City may designate. No part
of the engineer's fee may be assigned in advance of receipt by
the engineer without written consent of the City.
6. Technical Assistance and Consultations
The City shall not pay the fees of expert or technical assistance
and consultants unless such employment, including the rate of com-
pensation, has been approved in writing by the City.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
