TO PERFORM LABORATORY SERVICES NECESSARY DURING CON- STRUCTION OF STREET IMPROVEMENTS ON 15TH, 17TH, 18TH, ELIZABETH, PRESCOTT, DOLORES, AND ESPINOSA STREETS, PROJECT NO. 220 -67 -92.9, FOR $7,400, A COPY OF SAID PROPOSAL BEING ATTACHED HERETO AND MADE A PART HEREOF, THE COST OF SAID SERVICES TO BE PAID FROM CON- TINGENCY FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 11592 APPROVED JULY 25, 1973; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is here- by authorized to accept, for and on behalf of the City of Corpus Christi, the proposal of Trinity Testing Laboratories, Inc. to perform laboratory services necessary during construc- tion of street improvements on 15th, 17th, 18th, Elizabeth, Prescott, Dolores, and Espinosa Streets, Project No. 220 -67- 92.9, for $7,400, a copy of said proposal being attached here- to and made a part hereof, the cost of said services to be paid from contingency funds previously appropriated by Ordinance No. 11,592, approved by the City Council on July 25, 1973. SECTION 2. The necessity to immediately accept the proposal of Trinity Testing Laboratories, Inc. in order that the street construction of the hereinabove named streets may begin without delay creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect J_7' 5 • from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this th4A A day of October, 1973. We propose to furnish testing services for this project in accordance with the normal ratio of testing established by the Department of Engineering Services. Total charges for this service will be $7,400.00. This will be billed at the rate of $1,480.00 per month, with the first billing to be for services performed up to and including October 31, 1973. During construction, if job conditions require additional testing above your normal ratio of tests, our firm will absorb a 5% average at no addi- tional charge. Any average•above 5% will be charged at our regular fee for each unit of test. Attached to this proposal is a resume of our professional employees and laboratory personnel who will be directing and performing testing services for this project. Exe Nicks Executive vice President Attachment JBN /dh • Corpus Christi, Texas • jn,�k day of OL 19 7-3 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
