AN ORDINANCE
CLOSING AND ABANDONING THE 10-FOOT WIDE
DRAINAGE EASEMENT THROUGH A PORTION OF
TRACT L, SAVAGE LANE ADDITION, WHICH
EASEMENT IS DESCRIBED HEREINAFTER; PRO-
VIDING FOR SEVERABILITY; AND DECLARING
AN EMERGENCY .
BE IT ORDAINED BY THE.,'CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
WHEREAS, there exists a drainage easement in Tract L,
Savage Lane Addition, situated in Nueces County, Texas, as shown
by map or plat recorded in Volume 32, Page 128, Map Records of
Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible
and advantageous to the City of Corpus Christi to abandon said
easement to the abutting property owners as it is not now needed
by the City, nor will it within the foreseeable future be needed
by the City for any purpose whatsoever:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the drainage easement located in
Tract L, Savage Lane Addition, as shown by map or plat recorded
in Volume 32, Page 128, Map Records of Nueces County, Texas, be
and the same is hereby closed for public use and every municipal
purpose and abandoned to the owners of the abutting property,
in accordance with the laws of the State of Texas, and for the
service and interest of the inhabitants of the City of Corpus
Christi, Texas, said easement hereby abandoned being more fully
described by metes and bounds as follows, to -wit:
"Being a strip or parcel of land having a
width of 10 feet, 5 feet each side of a
centerline survey whose alignment is as
follows:
Beginning at a point in the South line of
said 30.11 acre tract, from whence the
Southeast corner of said tract bears North
830 27' East a distance of 72.6 feet;
Thence North 38° 48' West a distance of
11734
10 feet to a point of intersection on this
centerline survey; Thence North 81° 30'
West a distance of 300 feet to a point in the head
of a draw which flows into Nueces Bay;
The above described strip or parcel of land
contains a total of 0.071 acre, more or less."
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of
a court of competent jurisdiction it shall not affect any other
section, paragraph, subdivision, clause, phrase, word or pro-
vision of this ordinance, for it is the definite intent of
this City Council that every section, paragraph, subdivision,
clause, phrase, word or provision hereof be given full force and
effect for its purpose.
SECTION 3. The fact that the public convenience and
necessity would be better served by the closing of the aforesaid
easement creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date of
its introduction and that such ordinance or resolution shall be
read at three several meetings of the City Council, and the
Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the aday of
October, 1973.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
