HomeMy WebLinkAbout11744 ORD - 10/17/1973• JRR:jkh:hb:10 /16/73 • 1st AN ORDINANCE APPROPRIATING $6997 OUT OF NO. 220 STREET BOND FUND TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 10784, PASSED AND APPROVED ON APRIL 5, 1972, FOR ACQUI- SITION OF PARCELS 13 AND 14, SAID SUPPLE- MENTAL APPROPRIATION TO INCLUDE $6480 ADDITIONAL COMPENSATION FOR PARCEL 13 AND $77 ADDITIONAL COMPENSATION FOR PARCEL 14, IN ACCORDANCE WITH THE AWARD OF SPECIAL COMMISSIONERS, AND TO PROVIDE FUNDS FOR SPECIAL COMMISSIONERS' FEES AND APPRAISER'S FEES, ALL IN CONNECTION WITH ACQUISITION OF THE AFORESAID PARCELS FROM LAWRENCE J. BERGER, ET AL, IN CONNECTION WITH SOUTH STAPLES STREET IMPROVEMENTS, PADRE ISLAND DRIVE TO SARATOGA BOULEVARD, PROJECT NO. 220 -70 -107; AND DECLARING AN EMERGENCY, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated the sum of $6997 out of No. 220 Street Bond Fund to supplement funds previously appropriated by Ordinance No. 10784, passed and approved by the City Council on April 5, 1972, for acquisition of Parcels 13 and 14, said supplemental appropriation to include $6480 additional compensation for Parcel 13 and $77 additional compensation for Parcel 14, in accordance with the Award of Special Commissioners, and to provide funds for Special Commissioners' fees and appraiser's fees, all in connection with acquisition of the aforesaid parcels from Lawrence J. Berger, et al, in connection with Cause No. 688, styled City of Corpus Christi v. Lawrence J. Berger, et al, in condemnation proceedings, in connection with South Staples Street Improvements, Padre Island Drive to Saratoga Boulevard, Project No. 220 -70 -107. SECTION 2. The necessity to immediately provide the funds necessary to take possession of the aforesaid par- cels in order that the South Staples Street Improvement Pro- ject may continue without delay creates a public emergency and an imperative public necessity requiring the suspension x'744 of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emer- gency and necessity to exist, and having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the / 7� day of October, 1973.
