HomeMy WebLinkAbout11766 ORD - 11/07/1973JRR :jkh :hb:11 /6/73 • 1st AN ORDINANCE APPROPRIATING $4,250 OUT OF THE NO.295 STORM SEWER BOND FUND FOR COST OF REMOVAL OF ALL BUILDINGS OR STRUCTURES LOCATED WITHIN THE STORM SEWER EASEMENT ON PARCEI6, NO.12, WOOLDRIDGE- STAPLES OUTFALL PROJECT, NO.295- 70-66, SAID IFARCEL BEING OWNED BY CHARLTON F. FAIRLESS AND WIFE, ESTHER C. FAIRLESS; AND DECLARING AN EMERGENCY. BE IT ORDA;NED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated out of the No. 295 Storm Sewer Bond Fund the sum of $4,250 for cost of removal of all buildings or structures located within the storm sewer easement on Parcel No. 12, Wooldridge - Staples Outfall Project, No. 295- 70 -66, said parcel being owned by Charlton F. Fairless and wife, Esther C. Fairless, and said parcel being described by metes and bounds as follows: Being a strip of land 15 feet wide and approx- imately 626.0 feet long out of Tract A, Block 30, Bass Addition as shown by map of record in Volume 7, page 17, Nueces County, Texas, Map Records, said strip of land being more particularly described by metes and bounds as follows: Beginning at the most easterly corner of said Tract, the common corner of Lots 19, 20, 29, and 30, Section 19, Flour Bluff and Encinal Farm and Garden Tracts as shown by map of record in Volume A, pages 41, 42, and 43, Nueces County, Texas, Map Records for the most easterly and beginning corner of the tract herein described; Thence N. 60° 55' 30" W, with the northeast line of said Tract A, a distance of 626.45 feet to a point in the east right of way line of 60 foot wide Airline Road for the most northerly corner of the tract herein described; Thence S 20 19' 10" W, with the east right of way line of said Airline Road, a distance of 16.77 feet to a point for the southwest corner of the tract herein described; Thence S. 60° 55' 30" E, with a line that is 15.0 feet Southwest of and parallel to the Northeast line of said Tract A, a distance of 618.94 feet to a point in the Southeast line thereof, for the most southerly corner of the tract herein described; Thence N. 290 01' E, with the southeast line of 11766 said Tract A, a distance of 15.0 feet to the point of beginning. Containing 9340.4 square feet of land more or less. SECTION 2. The necessity to appropriate the herein- above described sums in order that the City may take possession of the necessary storm sewer easement and proceed with the Wooldridge - Staples Outfall Project without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its intro- duction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 7r"' day of November, 1973. FIN 2 -55 Revised 7/31/69 3 () , 19 '73 nirec or of ance Corpus Christi, Texas day of &4e TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
