AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE
SALES CONTPACT FOR THE ACQUISITION OF PARCEL 7 -B
OF THE WOOLDRIDGE - _STAPLES OUTFALL PROJECT FROM THE
OWNERS, BYRON N. COWARD AND WIFE, EMMA J. COWARD;
APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND
$4,200, OF WHICH $4,000 IS FOR LAND ACQUISITION AND
$200 IS FOR INCIDENTAL.COS.TS,.RgJATED TO CLOSING IN
CONNECTION WITH THE 5g4ID ACQUIS TION, APPLICABLE TO
PROJECT NO. 295- 70 -66; AND DECIMING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute a real estate sales contract with Byron N. Coward and wife,
Emma J. Coward, for the acquisition of Parcel 7 -B of the Wooldridge - Staples
Outfall Project, Project No. 295- 70 -66, said parcel being described as
follows:
Being a 0.989 acre tract of land out of Lot 22 Section 19, Flour Bluff and Encinal
Farm and Garden Tracts as shown by map of record in Volume A, pages 41, 42, and 43,
Map Records, Nueces County, Texas, said 0.989 acre tract of land being more part-
icularly described by metes and bounds as follows;
Beginning at the most southerly corner of said Lot 22; Thence N.29001'E. with
the Southeast line of said Lot 22, a distance of 15.0 feet; Thence N. 60a 55'
30 "W.,with a line that is 15.0 feet northeast of and parallel to the southwest
line of said Lot 22, a distance of 165.10 feet to a point, the P.C. of a curve
and the beginning corner of the tract herein described;
Thence in a Northeasterly direction with said curve to the left whose central angle
is 900 03'30 ", and whose radius is 100.0 feet, an arc distance of 157.18 feet to
a point the P.T. of.said curve for a corner of this tract;
Thence N. 290 O1'E., with a line that is 65.0 feet Northwest of and parallel to the
Southeast line of said Lot 22, a distance of 344.75 feet to a point, the P.C.
of a curve for a corner of the tract herein described;
Thence in a northeasterly direction with the arc of a curve to the right whose
central angle is 15037'46 ", and whose radius is 743.70 feet, an arc distance of
202.87 feet to a point in the Northwest right of way line of a 75 foot wide Drainage
Easement described in Volume 771, page 219, Nueces County, Texas, Deed Records
for the most easterly corner of the tract herein described;
Thence S. 29001'W., with the Northwest line of said drainage easement, a distance
of 155.92 feet to a point for an interior corner of the tract herein described;
Thence S. 60059'E., a distance of 37.5 feet to a point in the centerline of said
Drainage Easement and-in the Southeast line of said Lot 22, for a corner of the
tract herein described;
Thence S. 29 °01'W., with the Southeast line of said Lot 22, a distance of 489.16
feet to a point, of beginning.
Containing 0.989 of land more or less.
Together with a 70 foot wide temporary constract'ion easement lying Northeast of
the Northwest of and adjacent to the above described tract.
Temporary construction easement to be used only during period of construction.

SECTION 2. There is hereby appropriated out of No. 295 Storm
Sewer Bond Fund the sum of $4,200, of which $4,000 is for land acquisition and
$200 is for incidental costs related to closing in connection with the said
acquisition.
SECTION 3. The necessity to authorize the execution of the necessary
documents and to authorize the payment of funds for the acquisition of the
aforesaid parcel of land in order to proceed with the development of the
Wooldridge — Staples Outfall Project, creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor having declared that such emergency and
necessity exist, and having requested the suspension of the Charter rule and
that this ordinance be passed finally on the date of its introduction and
take effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the Zday of

I certify to the City Council that $ 4,200.00 , the amount required
for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi
to the credit of:

Project No. 295 -70 -66
Project Name Wooldridge - Staples Outfall Project
from which it is proposed to be drawn, and such money is not appropriated for
any other purpose.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
