AN ORDINANCE'
AUTHORIZING THE CITY MANAGER TO EXECUTE A PARKING
AGREEMENT WITH RANDY JONES FOR THE RENTAL OF A
PORTION OF LOTS 18 AND 19, A. BAGNALL TRACT, FOR
THE PURPOSE OF PROVIDING A PARKING FACILITY FOR
EMPLOYEES OF THE CORPUS CHRISTI- NUECES COUNTY DEPART-
MENT OF HEALTH AND WELFARE, ALL AS MORE FULLY SET
FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ";
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute a parking agreement with Randy Jones for the rental of a portion
of Lots 18 and 19, A. Bagnall Tract, for the purpose of providing a parking
facility for employees of the Corpus Christi- Nueces County Department of
Health and Welfare, all as more fully set forth in the agreement, a copy of
which is attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize the execution of the aforesaid
agreement in order that necessary construction may commence at the earliest
practicable date creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City Council, and
the Mayor having declared that such emergency and necessity exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this
the day of 1973.

PARKING AGREEMENT

WHEREAS, Randy Jones, 4325 Spring Road, has entered
into an agreement with the Annie M. Bagnall Estate to purchase
Lots 18`and 19 of the A. Bagnall Tract on Nueces Bay Boulevard;
and
WHEREAS, the Corpus Christi- Nueces County Department
of Health and Welfare desires to utilize the West 100 feet
of said Lots 18 and 19, A. Bagnall Tract, with an eighteen
(18')foot wide entrance road from Nueces Bay Boulevard, to the
West one hundred (100') feet of these lots for the use of Health
Department employees housed in a building at 620 -626 Old Robs -
town Road:
NOW, THEREFORE, for and in consideration of the
undertakings, covenants and understandings herein do the City
of Corpus Christi and the Corpus Christi- Nueces County Depart-
ment of Health and Welfare, hereinafter jointly referred to
as "City", and Randy Jones, hereinafter referred to as "Con-
tractor", covenant, agree, and contract as follows:
1. Contractor agrees to allow City to use the West
one hundred (1001) feet of the aforesaid Lots 18 and 19, A.
Bagnall Tract, with an eighteen (18')foot wide entrance road
from Nueces Bay Boulevard to the West one hundred (100') feet
of said lots for the use for parking by City's employees that
are now housed in a building at 620 -626 Old Robstown Road.
2. City agrees to regrade, provide and maintain
adequate drainage for the entire area of both said Lots 18
and 19, A. Bagnall Tract, and pave eighteen (18') foot wide
access road along the South side of Lot 19 and the 100' x 100'
parking area with minimum 6" compacted caliche base with a
2 course asphalt surface, for the privilege of using the West
one hundred (100') feet of said Lots 18 and 19', A. Bagnall
Tract, for Health Department personnel parking. At the end
of the period of this contract all improvements on said lots
shall remain intact at no cost to contractor and shall revert
to said contractor.
3. It is mutually agreed by and between the parties
hereto that contractor shall not be held liable for any
damages to vehicles of City personnel during the term of this
agreement.
4. The term of this contract shall be for a period
of three years from date of execution hereof, subject to re-
newal for one term of one year.
WHEREFORE, WITNESS OUR HANDS this the day of

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
