AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREE-
MENT WITH NUECES COUNTY IN CONNECTION WITH CLOSING OF
STREETS AROUND THE NEW NUECES COUNTY COURTHOUSE SITE,
ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY
OF WHICH IS ATTACHED HERETO, MARRED EXHIBIT 'W', AND
MADE A PART HEREOF; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
to enter into an agreement with Nueces County in connection with closing of
streets around the new Nueces County Courthouse Site, 611 as more fully set
forth in the agreement, a copy of which is attached hereto, marked Exhibit
'V, and made a part hereof.
SECTION 2. The necessity to immediately authorize the execution
of the aforesaid agreement in order that the new Nueces County Courthouse
may be constructed at the earliest practicable creates a public emergency
and an imperative public necessity requiring_ the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the
date of its introduction but that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule, and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

This Agreement made and entered into as of the day of ,
1973 by and between the City of Corpus Christi, Texas, a home -rule city and
body politic, hereinafter sometimes called the "City "hand the County of Nueces,
Texas, hereinafter sometimes called "County ".
W I T N E S S E T H
THAT WHEREAS, the County of Nueces is planning the construction of a new court-
house within a five (5) block area of the City of Corpus Christi generally
bounded by Tancahua, Comanche, Waco and Leopard Streets, and
WHEREAS the County of Nueces, Texas has requested that certain streets previously
dedicated be closed to allow the construction of the proposed new courthouse,
and
WHEREAS the streets to be closed are-
a) Mestina Street from Artesian to Carrizo
b) Carrizo Street from Mestina to Lipan
c) Artesian Street from Mestina to Lipan and
WHEREAS the closing of said streets by the City of Corpus Christi will require
that a number of utilities as well as drainage storm sewer will need to be
relocated, and
WHEREAS the construction of the courthouse will require that portions of exist-
ing streets around the courthouse property be widened to better serve the public,
and
WHEREAS certain easements will have to be retained to allow the proper function-
ing of utilities and to allow the proper maintenance of same;
NOW THEREFORE, the City and County agree as follows:
The City of Corpus Christi will perform the following:
1) Pursuant to public hearing held, these streets shall be closed:
a) Mestina Street from Artesian to Carrizo
b) Carrizo Street from Mestina to Lipan
c) Artesian Street from Mestina to Lipan
2) City shall retain a twenty foot (201) wide storm sewer and
utility easement, thus, the portion of Carrizo Street to be
closed described as follows:

Being a 20.0 foot wide by 350.0 foot long strip of land out of
that portion of Carrizo Street between Mestina Street and Lipan
Street said portion of Carrizo Street to be closed by City
Ordinance, as shown by Bluff Portion of Map of Records in Volume
40, Page 1, Map Records, Nueces County, Texas, said strip of
land being more particularly described by metes and bounds as
follows:
Beginning at point on Carrizo Street, said point being South 880
39' East, 23.0 feet from the northeast corner of Block 26, said
Bluff Portion for the northwest and beginning corner of the tract
herein described;
Thence South 880 39' East, a distance of 20.0 feet to a point
for the northeast corner of the tract herein described;
Thence South 10 29' 27" West, a distance of 350.0 feet to a
point in the north right -of -way line of Lipan Street for the
southeast corner of the tract herein described;
Thence North 88° 39' West, with the north right -of -way line
of said Lipan Street a distance of 20.0 feet to a point, from
whence the southeast corner of said Block 26, beers North 88°
39' West, 20.0 feet for the southwest corner of the tract
herein described;
Thence North 1° �9' 27" East, a distance of 350.0 feet to the
point of beginning. Containing 7000.0 square feet of land more
or less.
3) City shell prepare all necessary plans for the relocation of
utilities and storm sewer resulting from the closing of said street.
4) City shall contract for or itself perform the work of said
relocation.
The County shall perform the following:
1) Dedicate a twenty foot (20') wide storm sewer and utility
easement, the description of which is as follows:
Being a 20 foot wide by 300 foot long strip of land out of
Block 25, Bluff Portion as shown in Volume A, Pages 2 and 3
and Volume 40, Page 1, Map Records, Nueces County, Texas,
said strip of land being more particularly described by metes
and bounds as follows:
Beginning at a drill hole at the intersection of the east right-
of-way line of 60 foot wide Artesian Street and the south right -
of -way line of 80 foot wide Leopard Street, said point being
South 1° 00' West, 10.0 feet from the original northwest corner
of the tract herein described;
Thence South 88° 39' East, with the present south right -of -way
line of Leopard Street and with a line that is 10.0 feet south
of and parallel to the original north line of said Block 25,
a distance of 300.0 feet to a drill hole in the west right -of-
way line of Carrizo Street, the east line of said Block 25,
for the northeast corner of the tract herein described;
Thence South 1° 00' West, with the west right -of -way of said
Carrizo Street, the east line of said Block 25, a distance of
20.0 feet to a point the southeast corner of the tract herein
described;
Thence North 880 39' West, with a line that is 20.0 feet south
of and parallel to the present south right -of -way line of said
Leopard Street, a distance of 300.0 feet to a point in the east
right -of -way line of said Artesian Street, the west line of
said Block 25, for the Southwest corner of the tract herein
described;
Thence North 10 00' East, with the east right -of -way line of
said Artesian Street, the west line of said Block 259 a distance
of 20.0 feet to the point of beginning. Containing 6000.0
square feet of land more or less.
2) Nueces County will reimburse the City of Corpus Christi or pay
directly to the contractors engaged by the City to perform the
described work, at the County's option, for the costs incurred
in relocating, relaying, or abandoning all water lines, gas
lines, sanitary sewer lines and storm sewer lines in connection
with the closing of the herein described portions of Artesian,
Carrizo and Mestina Streets. The relocation, relaying or
abandon -mant pl= for the utility lines described herein is on
file in the office of the Director of Engineering and Physical
Development. Nueces County will reimburse the City of Corpus
Christi or the contractors through the City, as bereinbefore
stated at the County's option, for relocations, relaying or
abandonment costs after each or all of the affected utility
lines have been relayed, relocated or abandoned. For clarifica-
tion purposes, reimbursement shall mean the actual direct costs
involving all materials, labor, or contract costs plus 6 1/2%
Engineering as Engineering Fee.
3) Nueces County agrees to replat only for the purposes and items
stated in this Agreement all property owned by it contiguous to
said described portions of Carrizo, Mestina and Artesian Streets
or more specifically all portions of Blocks 17, 25, 32, 27 and
26 Bluff Portion and without park dedication.

4) The County shall barricade the streets closed, as herein
described, after closure by the City and when no longer in
use and the street structures have been removed by the
County.
5) The County shall install additional facilities to take water
from Carrizo Street and Lipan Street for approximately 3 1/2
blocks to the Blucher Park outfall in order to capacitate
increased runoff anticipated from current development of the
new courthouse site. The City shall provide easements for said
drainage to Blucher Park and shall maintain said facilities
after completion.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
