MESTINA STREET FROM THE EAST RIGHT OF WAY LINE OF ARTESIAN STREET TO THE WEST RIGHT OF WAY LINE OF CARRIZO STREET; 2. ARTESIAN STREET FROM THE NORTH RIGHT OF WAY LINE OF LIPAN STREET TO THE SOUTH RIGHT OF WAY LINE OF MESTINA STREET; AND 3. CARRIZO STREET FROM THE NORTH RIGHT OF WAY LINTS OF LIPAN STREET TO THE SOUTH RIGHT OF WAY LINE OF MESTINA STREET, CONDITIONED UPON THE EXECUTION OF A CONTRACT BY NOECES COUNTY THIS DATE AUTHORIZED BY THE CITY COUNCIL TO BE ENTERED INTO BETWEEN THE CITY OF CORPUS CHRISTI AND NUECES COUNTY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a portion of the hereinafter described streets was given by publication and mailed to the last known address of the owners of property abutting said streets and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, September 19, 1973, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portion of streets within the limits hereinafter described, for use as public streets, subject to certain conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portions of streets described as follows be and the same are hereby closed for use as public streets and abandoned to the owner of the abutting properties, the same being Nueces County, said portions of streets being as followsf 1. Mestina Street from the east right of way line of Artesian Street to the west right of way line of Carrizo Street, 11803 2. Artesian Street from the north right of way line of Lipan Street to the south right of-way line of Mestina Street, and 3. Carrizo Street from the north right of way line of Lipan Street to the south right of way line of Mestina Street; said closings, however, are conditioned upon the execution of a contract by Nueces County this date authorized by the City Council to be entered into between the City of Corpus Christi and Nueces County, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the said streets as aforesaid creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolutionl,shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in fulllforee and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the day of November, 1973.
