HomeMy WebLinkAbout11809 RES - 11/28/1973• JRR:MLM:jkh:ll- 284 -73; 1st i A RESOLUTION ESTABLISHING A POLICY FOR RELOCATION OF PERSONS AND PLACES OF BUSINESS REQUIRED TO MOVE FROM REAL PROPERTY OCCUPIED AS A D14ELLING ON LAND ACQUIRED FOR CITY USE; AND DECLARING AN EMERGENCY. WHEREAS, in the City of Corpus Christi, numerous projects are underway or are to commence within a short period of time, which projects will necessitate the relocation of persons from the subject properties; and WHEREAS, it is the desire of the City Council to establish a policy for relocation of the aforesaid persons in order that the projects may continue without delay: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. It shall be the policy of the City of Corpus Christi that no person shall be displaced unless and until adequate housing is available to any family or individual who is required to move from real A.....114 -- nn 1,-A —fled Fnr Cir.. . ,.•...,. ..... a .ve SECTION 2. It shall be the policy that relocation assistance will be available to individuals, families, businesses or other organizations displaced as a result of a City project. This assistance applies to tenants as well as owners occupying property needed by the City. A displaced person, family or business, is one who is in occupancy the date the acquiring agency makes the first personal contact with the owner, or his designated representative, where the price for the property to be acquired is discussed. This contact is called the "initiation of negotiations for the parcel." The property must be subsequently purchased by the acquiring agency. Before any moving expenses or relocation benefits are payable under this policy, the City must be assured possession of the premises as bargained for. SECTION 3. It shall be the policy of the City of Corpus Christi that sufficient notice be given in order to provide for an orderly, timely and efficient relocation. Ta the greatest extent practicable, no person, family or business, lawfully occupying real property will be required to move without at least a 90 -day notice. It shall be the policy of the City of Corpus Christi that sufficient assistance and information will be provided to displacees in order to effectuate a move that is the least disruptive to family life and business activity. The amount and kind of assistance will be determined by the needs of the persons or businesses displaced. SECTION 5. It shall be the policy of the City of Corpus Christi that an individual, family or business is eligible to receive payment for the reasonable expenses of moving when he is in lawful, physical occupancy at the initiation of negotiations for the property and the property is then acquired. SECTION 6. The necessity to immediately establish a policy for relocation of persons in order that various projects underway in the City of Corpus Christi may be commenced, or proceed without delay, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance orresolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspensim of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this theday of, 1973.
