HomeMy WebLinkAbout11811 ORD - 11/28/19730 JRR:vp:11/28/73:lst • AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO ESTABLISH A HOUSING REHABILITATION PILOT PROGRAM FOR THE PERIOD BEGINNIlVG DECEMBER 16, 1973, AND ENDING JULY 31, 1974; CONTAINING FINDINGS; APPROPRIATING $126,000 FROM NO. 122 GENERAL REVENUE SHARING FUND; AUTHORIZING THE EMPLOY- MENT OF EIGHTEEN PERSONS OF THE PRESENT NEIGHBORHOOD IMPROVEMENT DIVISION'S STAFF FOR PERFORMANCE OF THE CITY'S OPERATIONS UNDER SAID PROGRAM; AUTHORIZING CONTINUATION OF THE NEIGHBORHOOD IMPROVEMENT DIVISION OPERATIONS AS DIRECTED AND PROVIDED BY CITY ORDINANCE 9811, AS AMENDED, CITY ORDINANCE 10730, AS AMENDED, AND CITY ORDINANCE 11596; PRESCRIBING GUIDELINES FOR THE NO. 122 FUNDING; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, the memorandum of November 23, 1973, of E. M. Briones, Director of Planning and Urban Development, subject: Proposal for Establishing a Locally Funded Housing Rehabilitation Program, has been presented to the City Council by the City Manager; and WHEREAS, there is an existing Substandard Housing Improvement Work Program being conducted by the Neighborhood Improvement Division of the City for several years through the Federal Categorical Grant Funds in the federally assisted Code Enforcement Program, now terminating, whereby the City performed with authority of the government of the United States, expenditures of Federal funds in said program as a contract agent of the United States government; and WHEREAS, it is the finding of the City Council that this work has measureably benefitted the public health, safety, and welfare of the City and its inhabitants; and WHEREAS, it is the finding of the City Council that the continuation of the program with concentration in the Carver Addition, the Austin School Area, and unimproved sections of Molina Addition, will substantially advance the public health, safety, and welfare of the City and its inhabitants; and WHEREAS, it is the finding of the City Council that the City has general revenue sharing funds available for expenditure in substandard hous- ing improvement by general trust authority of the Local Fiscal Assistance Act for purposes therein authorized and under Article 1175 4a the City Charter; 1/ and WHEREAS, it is the finding of the City Council that the City should further implement said improvement program by assisting substandard housing property owners in referrals to lending institutions and private home improve- ment agencies for the purpose of securing means for making such improvements; 11811 NOW, THEREFORE, BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated the sum of $126,000 from No. 122 General Revenue Sharing Fund of the City budget for expenditure during a period beginning December 16, 1973 and ending July 31, 1974 for the purpose of accomplishing the work and employing the persons as authorized and provided by this ordinance. SECTION 2. The City Manager is hereby authorized and directed to provide for the employment of eighteen persons of the present Neighborhood Improvement Division's staff for performance of the City's operations under the program hereunder authorized and described. These persons shell be com- pensated as provided by the City Compensation and Classification Plan and as further prescribed by the City Manager in accordance therewith and within the funding herein provided and within the funding appropriated and allocated under the City of Corpus Christi Budget, Fiscal 1973 -1974. SECTION 3. Authorization is hereby granted for the continuation of the Neighborhood Improvement Division operations as directed and provided by City Ordinance 9811, as amended, City Ordinance 10730, as emended, and City Ordinance 11596. SECTION 4. The following guidelines are hereby prescribed for the expenditure of the appropriation herein made out of No. 122 General Revenue Sharing Fund of the City budget: 1. Neighborhood Improvement Division property advisors shall con- duct house by house inspections of all properties in the areas designated in the preamble of this ordinance and in such other areas as authorized by the City Manager consistent with the authority of this ordinance on a systematic basis. 2. Neighborhood Improvement Division shell establish a close coop- eration with the Neighborhood Councils in each area prescribed for substandard housing improvement. 3. Property owners of substandard housing thus inspected shell be provided with an inspection report at the time of inspection as well as be furnished advice of the immediate hazards to health, safety, or public welfare. -2- 4. Owners of substandard rental property shall be required to effect sufficient improvements to bring the property up to livable standards as prescribed by the above cited ordinances of the City of Corpus Christi (set forth in the preamble hereof). 5. Owners of vacant lots with high weeds and debris, as defined by the ordinances and rules and regulations of the City, shall be caused to abate such conditions on their premises. 6. The Neighborhood Improvement Division shall, upon the request of the owners or occupants of those premises, advise such persons as to the corrective measures required to abate the substandard conditions. 7. Upon request of such persons the Neighborhood Improvement Division shall assist such persons in securing contract improvement of the subject property through negotiations and referrals to contractors. 8. The Neighborhood Improvement Division may assist the property owner and the contractor for him in developing estimates of cost to correct the substandard conditions and may assist such property owner in any lawful manner in obtaining referral to private lending institutions and private home improvement agencies for the purpose of effecting such improvements. In the event of the refusal or failure of a private lending institution or private home improvement agency to assist such property owner in the preparation of his application for a loan with which to accomplish such improvements, the Neighborhood Improvement Division may aid such property owner in the prepara- tion of the application. 9. The Neighborhood Improvement Division may periodically inspect the remodelling, alteration, removal, demolition, and cleaning operations in progress on substandard property for the purpose of assuring, in collaboration with inspectors of the office of the Building Official, that such work, when completed, will meet the minimum housing standards and safety requirements of the ordinances, rules and regulations of the City of Corpus Christi. In cases where the lending institution, if any, or the property owner, fail to provide a clerk of the works to see that the improvement work is done in accordance with applicable City ordinances, regulations and rules, the Neighborhood Improvement Division may act in any lawful manner in such capacity for the purpose of verifying that such work meets the standard of such City ordinances, rules and regulations. 5Z SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 6. The necessity to establish a Housing Rehabilitation Pilot Program for the period beginning December 16, 1973 creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Cheater rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the a1 tt day of November, 1973.
