HomeMy WebLinkAbout11817 ORD - 12/12/1973JRR:jkh:11- 21 -73; 1st L7 AN ORDINANCE AMF,11IliING ARTICLE XXIX OF THE BUILDING CODE, ADOPTED BY ORDINANCE N0. 10379, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 10636, BY REPEALING THE SAME AND IN LIEU THEREOF ADOPTING A NEW CHAPTER XXIX ESTABLISH- ING A SEVEN -FOOT MINIMUM ELEVATION ABOVE MEAN TIDE LEVEL FOR ALL BUILDINGS AND STRUCTURES WITHIN THE CORPORATE LIMITS AND PROVIDING EXCEPTIONS TO REQUIRE THAT RESI- DENTIAL BUILDINGS, INCLUDING MOBILE HOMES, ERECTED AFTER EFFECTIVE DATE HEREOF HAVE A MINIMUM FIRST FLOOR ELEVATION OF 13 TO 17 FEET IN DEFINED AREAS ADJACENT TO CAYO DEL OSO AND THE NUECES RIVER; DESIGNATING MATERIAL AND DESIGN STANDARDS FOR WINDOW GLASS IN SAID AREAS; DECLARING EVERY VIOLATION HEREOF A MISDEMEANOR SUBJECT TO FINE NOT EXCEEDING $200; PROVIDING FOR PUBLICATION; AND PROVIDING A SAVINGS CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter XXIS of the Building Code, adopted by Ordinance No. 10379, as amended, and particularly as amended by Ordinance No. 10636, be and the same is hereby repealed in its entirety, and in lieu thereof, there is hereby adopted a new Chapter XXIX of the Building Code, to hereafter read as follows: "CHAPTER XXIX. No building or structure shall be hereafter erected in the corporate limits of the City having a first floor elevation of less than seven (7') feet above mean tide level as established by the U. S. Coast and Geodetic Survey Bench Nark Datum and no building or struc- ture shall be hereafter erected upon a natural grade of less than seven (7') feet elevation above mean tide level as established by the U. S. Coast and Geodetic Survey Bench Mark Datum, except as hereinafter expressly provided. "All buildings classified as Group 'A' - Residential Occupancy and all occupied mobile homes shall have a minimum first floor elevation of twelve il2`) feet above mean tide level as established by the U. S. Coast and Geodetic Survey Bench Mark. Datum, except in those areas specified by Exhibits 'A' and 'B', hereby incorporated herein by this reference, where the minimum elevation shall be thirteen (13') feet, fourteen (10) feet, fifteen (15') feet, sixteen (16') feet, or seventeen (17') feet as therein indicated. In addition all buildings or structures having a minimum first _ floor elnva` on le_; _n the cin'_ um required of buildings classified as Group 'A' - Resi.de., -- ;:7. CccupLazy shall be designed so as to minimize A S11 • r damage from wind and rising water and to safeguard utilities and shall be designed by an architect or engineer legally and currently registered under the laws of the State of Texas. "The foregoing minim�mt floor elevation requirements shall not apply in areas protected by seawalls of at least twelve (121) feet elevation above mean tide level as established by the U. S. Coast and Geodetic Survey Bench Mark Datum where such areas are completely enclosed within a contour of at least twelve (12') feet. "Store front display windows and other windows larger than six (6) square feet in area in such buildings or structures which are not protected by a seawall of at least twelve (12') feet elevation shall be protected by a removable storm protection readily installable designed to withstand the action of wind and rising water." SECTION 2. Any person, firm or corporation violating the terms of this ordinance shall be deemed guilty of a misdemeanor as to each such violation, and upon conviction therefor, shall be fined as to each such misdemeanor in a sum not to exceed $200. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi, one time, which publication shall contain the caption stating in substance the purpose of the ordinance and reciting the penalty for violation of the ordinance. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance -shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. • That the foregoing ordinance was read for the first time and passed to its second reading on this the 1[ day of W4—.e� . 19 73 , by the following vote: Jason Luby James T.
