AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR
CONSTRUCTION OF MATLOCK STREET AND COUNTRY CLUB DRIVE
STORM SEWER IMPROVEMENTS WITH HELDENFELS BROTHERS;
APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND
$42,000, OF WHICH $32,750 IS APPLICABLE TO PROJECT NO.
295 -70 -67.1, MATLOCK STREET, $30,680 BEING FOR THE
CONSTRUCTION CONTRACT AND $2,070 BEING FOR CONTINGENCIES
AND INCIDENTAL EXPENSES; AND $9,250 IS APPLICABLE TO
PROJECT NO. 295- 72 -13, COUNTRY CLUB DRIVE, $8,664 BEING
FOR THE CONSTRUCTION CONTRACT AND $586 BEING FOR CONTIN-
GENCIES AND INCIDENTAL EXPENSE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute a contract with Heldenfels Brothers for construction of Matlock
Street and Country Club Drive Storm Sewer Improvements, all as is more fully
described in the plans and specifications and contract documents on file in
the office of the City Secretary, all of which are made a part hereof by
reference and according to the bid of Heldenfels Brothers, opened on the 21st
day of November, 1973, said bid being the lowest and most advantageous to the
City of Corpus Christi.
SECTION 2. There is hereby appropriated the sum of $42,000 out of
No. 295 Storm Sewer Bond Fund, of which $32,750 is applicable to Project No.
295 -70 -67.1, Matlock Street, $30,680 being for the construction contract and
$2,070 being for contingencies and incidental expenses; and $9,250 is applicable
to Project No. 295- 72 -13, Country Club Drive, $8,664 being for the construction
contract and $586 being for contingencies and incidental expense.
SECTION 3. The necessity to execute the aforesaid contract and to
appropriate the sums hereinabove set out at -the earliest possible date so that
construction may commence, creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or res
resolution shall be passed finally on the date of its introduction and that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared that such emergency and necessity exist,
and having requested the suspension of the Charter rule and that this ordinance
be pass_d finally on the date of its introduction and take effect and be in full

force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
