HomeMy WebLinkAbout11832 ORD - 12/12/1973• JRR:MLM:vp:12 /12/73:2d . • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO TRANSFER LAND EQUIVALENT IN VALUE TO THE LAND NOW LEASED TO THE CORPUS CHRISTI AIRPORT DEVELOPMENT CORPORATION TO AIRPORT USE, AS PRO- VIDED IN THE GRANT ENCUMBRANCE WHEREIN ORIGINAL AIRPORT LANDS WERE ACQUIRED WITH MATCHING FEDERAL FUNDS IN ORDER TO RELIEVE THE CORPUS CHRISTI AIRPORT DEVELOPMENT CORPO- RATION LAND FROM ANY FEDERAL GRANT ENCUMBRANCES, OR IN THE ALTERNATIVE AUTHORIZING THE CITY MANAGER TO PAY THE FEDERAL AVIATION AGENCY AN AMOUNT NOT TO EXCEED $25,000 TO RELIEVE THE CORPUS CHRISTI AIRPORT DEVELOPMENT CORPO- RATION LAND FROM ANY FEDERAL GRANT ENCUMBRANCES; APPRO- PRLATING $25,000 OUT OF NO. 245 AIRPORT BOND FUND FOR PROJECT NO. 245- 68 -18, LAND ACQUISITION REIMBURSEMENT TO FAA; PROVIDING SEVERABILITY; AND DECLARING AN EMER- GENCY. BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to transfer Corpus Christi International Airport land, not acquired with Federal funds, to the Federal Aviation Agency or its designated agency, such land to be equivalent in value to the land now leased at Corpus Christi International Airport to the Corpus Christi Airport Development Corporation to airport use, as provided in the Grant encumbrance wherein original airport lands were acquired with matching Federal funds in order to relieve the Corpus Christi Airport Development Corporation land from any Federal Grant encumbrances, or in the alternative authorizing the City Manager to pay to the Federal Aviation Agency an amount not to exceed $25,000 to relieve the Corpus Christi Airport Development Corporation land from any Federal Grant encumbrances. SECTION 2. There is hereby appropriated out of No. 245 Airport Bond Fund the sum of $25,000 for the purposes aforesaid. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. 11832 • • SECTION 4. The necessity to relieve the lands leased to the Corpus Christi Airport Development Corporation from any Federal Grant encumbrances creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of December, 1973.
