HomeMy WebLinkAbout11837 ORD - 12/19/1973JRR:jkti:hb:11 /28/73: 1st AN ORDINANCE AMENDING THE BUILDING CODE, ADOPTED BY ORDINANCE NO.10379, AS AMENDED; THE ELECTRICAL CODE, ADOPTED BY ORDINANCE N0.10832; AND THE PLUMBING CODE ADOPTED BY ORDINANCE NO.11238; SO AS TO EXEMPT FEDERAL, STATE, AND COUNTY GOVERNMENTAL AGENCIES FROM THE REQUIREMENT FOR PAY- MENT OF PERMIT FEES; PROVIDING A SAV- INGS CLAUSE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Building Code, adopted by Ordinance No. 10379, as amended, be amended by adding to Section 107 - FEES, of Chapter 1, a new subsection, to be numbered 107.9, to hereafter read as follows: "Subsection 107.9 - Reduced Fees. Agencies of the federal, state, and county governments are exempt from the payment of fees in connection with the construction or repair of buildings used, owned, and located on property owned by said governmental agencies. Permit fees for public schools, other political subdivisions having ad valorem tax - exempt status, and for church buildings and structures having ad valorem tax - exempt status shall be fifty per cent of the regular permit fee." SECTION 2. That the Electrical Code, adopted by Ordinance No. 10832, be amended by amending paragraph (e) of Section 4 -3: PERMIT FEES to hereafter read as follows: "(e) Agencies of the federal, state, and county governments are exempt from the payment of fees in connection with the construction or repair of buildings used, owned, and located on property owned by said governmental agencies. Permit fees for public schools, other political subdivisions having ad valorem tax - exempt status, and for church buildings and structures having ad valorem tax - exempt status shall be I'd a- 1337 fifty per cent of the regular permit fee." SECTION 3. That the Plumbing Code, adopted by Ordinance No. 11238 be amended by amending paragraph (g) of subsection 106.2 - SCHEDULE OF PERMIT FEES of CHAPTER 1- ADMINISTRATION to hereafter read as follows: "(g) Agencies of the federal, state, and county governments are exempt from the payment of fees in connection with the construction or repair of buildings used, owned, and located on property owned by said governmental agencies. Permit fees for public schools, other political subdivisions having ad valorem tax - exempt status, and for church buildings and structures having ad valorem tax- exempt status shall be fifty per cent of the regular permit fee." SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made in the official publication of the City of Corpus Christi, one time, which publication shall contain the caption stating in substance the purpose of the ordinance.
