HomeMy WebLinkAbout11857 ORD - 12/26/1973JRR:jkh:hb:12 /26473:lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PAR- TICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF DIOMEDE GRISSINO BY GRANTING A SPECIAL COUNCIL PERMIT FOR APARTMENT UNITS, SUB- JECT TO THE CONDITIONS HEREINAFTER SET FORTH, ON 3.47 ACRES OF LAND OUT OF LOT 14, SECTION -HAND LOT 3, SECTION C, PAISLEY SUBDIVISION OF THE HOFFMAN TRACT, MORE FULLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City :Council its reports and recommendations concerning the application of Diomede Grissino for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, November 21, 1973, at regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the here- inafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City Of Corpus Christi, Texas, passed on the 27th day of August 11857 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted covering a 3.47 acre -tract of land out of Lot 14, Section H and Lot 3, Section C, Paisley Subdivision of the Hoffman Tract, more fully described hereinafter, for apartment units, limited to 66 units, and meeting access requirements, all as more particularly described on the site plan, approved by the Planning Commission, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ", and subject to all other conditions of A -1 Zoning District: FIELDNOTE description for being a 3.47 acre tract of land out of Lot 14, Section H and Lot 3, Section C of Paisleys Subdivision of the Hoffman Tract and out of the Lewis & Willard Tract, Nueces County Texas; Beginning at a point on the northeast boundary of Horne Road, the most southerly corner of Lot 1, Block 12, Arcadia Village Subdivision, as shown by map recorded in Volume 7, Pages 43 and 44 of the map records of Nueces County, Texas, said Point of Beginning being the west corner of this tract; Thence north 289 13' 40" east with the south- east boundary of said Block 12, 404.36' for the most westerly north corner of this tract; Thence south 370 44' 50" east, 183.44' to a 1/2" iron rod for an inside corner of this tract, Thence north 441 55' east, with the northwest boundary of the Lewis & Willard Tract which is also the southeast boundary of said Lot 14, Section H, 130.0' to a 5/8" iron rod set in a 1" iron pipe found in the southwest boundary of the former Texas State Guard Army Property, which is also the southwest boundary of Houston Street, for a northerly corner of this tract; Thence south 450 05' east, with said south- west boundary of Houston Street, 242.54' for -2- the east corner of this tract in the north- west boundary of Ramsey Street; Thence south 44° 55' west with said north- west boundary of Ramsey Street, 243.85' to the point of curvature of a curve to the right which has a central angle of 84° 28', a radius of 242.54', a tangent distance of 220.18' and an arc length of 357.56'; Thence along said curve to the right for an arc distance of 357.56' to the Point of Tan- gency on the northeast boundary of Horne Road; Thence north 50° 37' west, with said north- east boundary of Horne Road, at 23.49' pass a 3/4" iron pipe found in the common boundary of said Lewis & Willard Tract and Lot 3, Section C, Paisley's Subdivision of the Hoffman Tract, in all a distance of 89.65' to the PLACE OF BEGINNING containing 3.47 acres of land, more or less. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, appli- cable to the property included in the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its -3- • introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its in- troduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of December , 1973.
