HomeMy WebLinkAbout11858 ORD - 01/02/1974JRR *cd:12- 7- 73:lst • w AN ORDINANCE AMENDING ORDINANCE NO. 8294, KNOWN AS THE BAY DRILLING ORDINANCE, AS AMENDED, BY DELETING THE PRESENT SUBSECTION 19.4 AND IN LIEU THEREOF SUBSTITUTING A NEW SUBSECTION 19.4 SO AS TO, IN CERTAIN CASES, WAIVE THE STORM CHOKE REQUIRE- MENT IN FLOWING WELLS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION. WHEREAS, operations for the production of oil and gas within the city limits of the City of Corpus Christi, Texas, are regulated by the provisions of the "Bay Drilling Ordinance," Ordinance No. 8294, as amended; and WHEREAS, such operations in certain bay areas have been regulated by said ordinance, as the same has been amended from time to time; and WHEREAS, developments in these bay areas and in the City of Corpus Christi and its environs require that these provisions for regulations of operations for such production be further amended; and WHEREAS, the City Council desires and intends by this ordinance to protect the public health, safety, morals and general welfare within its jurisdiction, and in so doing to regulate the use of property and the conduct of persons to any required extent within its municipal powers, with due regard for the legal rights of owners; and WHEREAS, the City Council, therefore, finds that adoption of the following ordinance is in the public interest: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8294, generally referred to and known as the Bay Drilling Ordinance of the City of Corpus Christi, as amended, be amended by deleting the present Subsection 19.4 and in lieu thereof, adopting a new Subsection 19.4 to hereafter read as follows: "19.4 All flowing wells shall be equipped with a sub- surface safety valve (storm choke) installed in the tubing string, unless a tubingless completion is involved. This valve shall be pulled and inspected between April 1 and October 1 of each year and more often if desired by lessee. However, in certain circumstances due to pressure and flow in the well the subsurface safety valve (storm choke) requirement can be waived. In the event that the Railroad Commission of Texas issues an order which has the effect of authorizing the removal of such a subsurface safety m r ✓O n r valve, application can then be made to the Petroleum Superintendent for waiver of this requirement. Upon written request for waiver from the operator for a part- icular well, the Petroleum Superintendent shall evaluate the flow and pressure in that well and using appropriate engineering guidelines to prevent any pollution of the Bay he may waive the requirement for the subsurface safety valve (storm choke)." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3.
