AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE
AGREEMENT WITH CORPUS CHRISTI BANK AND TRUST
COMPANY FOR LEASING A PORTION OF A BUILDING
LOCATED AT 1630 SOUTH BROWNLEE FOR 12 MONTHS
AT THE RATE OF $1388.40 PER MONTH FOR USE AS A
MULTI- PURPOSE FACILITY IN THE CITY'S SENIOR
COMMUNITY SERVICES PROGRAM, A COPY OF WHICH
LEASE AGREEMENT IS ATTACHED HERETO AND MADE
A PART HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:

SECTION 1. That the City Manager be and he is hereby authorized
to execute a lease agreement with Corpus Christi Bank and Trust Company
for the leasing of a portion of a building located at 1630 South Brownlee
for a term of 12 months at the rate of $1388.40 per month for use as a
multi- purpose facility in the City's Senior Community Services Program,
all as set forth in the Lease Agreement, a copy of which is attached hereto
and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize the execution of the
aforesaid lease agreement at the earliest practicable date in order that
the City's Senior Community Services Program may be commenced without
delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction and that such
ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the day of January, 1974.

A G R E E M E N T
KNOW ALL MEN BY THESE PRESENTS:
THIS Agreement of Lease made this day of January, 1974, by and
between Corpus Christi Bank and Trust, known herein as LESSOR; and The City of
Corpus Christi, Texas, a municipal corporation and body politic operating under
a home rule charter under the laws of the State of Texas, known herein as
LESSEE. (The terms "Lessor" and "Lessee" shall be construed in the singular or
plural number according as they respectively represent one or more than one
person), WITNESSETH:
The said Lessor does by these presents lease and demise unto the said Lessee
the following property, to -wit: Lying in and being situated in Corpus Christi,
County of Nueces, State of Texas, and being described more particularly as
follows:
The hereinafter described portions of the office complex known as
COS Building bearing the address 1630 South Brownlee, Corpus
Christi, Texas, and located on Lots 14, 15, 16, 17, 18, 46, 47,
48, 49, 50, Block 1003, Fitchue Place, an addition to the City of
Corpus Christi, Nueces County, Texas, shown by map or plat recorded
in Volume 2, page 14, map records of Nueces County, Texas, the areas
and rooms of said office complex which are hereby leased being speci-
fically described as follows: those areas located on the ground floor
of said office complex and being designated as the reception room, two
large meeting rooms, eight office rooms, one coffee room, one large
adjoining office with separate entrance, and other smaller rooms lo-
cated on the ground floor of such office building complex, the said
areas hereby leased comprising approximately 3,560 square feet of
area within such office building complex;
fora term of one (1) year beginning at 8 A.M. the first day of February,
1974, and ending the 31st day of January, 1975, with an option to renew
for a like period, by Lessee's giving written notice 30 days prior to ex-
piration hereof, paying therefor the sum of Sixteen Thousand Six Hundred
Sixty and 80 /100 Dollars ($16,660.80) payable in monthly installments of
One Thousand Three Hundred Eighty - Fight and 40/100 Dollars ($1,388.40) pay-
able on or before the first day of each month by mailing to Corpus Christi
Bank and Trust, 801 Leopard Street, Corpus Christi, Texas, upon the conditions
and covenants following:
First. Lessor agrees to clean and paint all leased area prior to occupancy
by Lessee and provide for all custodial and maintenance care of the premises
in accordance with direction of Lessee for the duration of this agreement.

Second. Lessor agrees to maintain the heating and air - conditioning equip-
ment, as well as plumbing, except as caused by Lessee's negligence.
Third. Lessor agrees to assure that all doors, locks, lights, commodes,
water fountains are in working condition prior to Lessee's occupancy.
Fourth. It is understood and agreed that the premises hereby leased are
to be used and operated by the Lessee as a Senior Citizens Multi- Purpose Center
and that Lessee shall furnish and equip the leased premises for such use and
purpose. Lessee may make such renovation, alteration or improvement as it
deems fit for the recreational and social activities contemplated for such
intended use, provided that there shall be no structural or other dhange of a
major nature without first obtaining the written consent of Lessor.
Fifth. That Lessee will well and PUNCTUALLY pay said rents in.the manner
and form as hereinabove specified and quietly deliver up said premises on the
day of expiration of this lease, in as good condition as the same were in when
received, reasonable wear and tear thereof excepted.
Sixth. That the said premises be used by the Lessee for a multi- purpose
senior center for the City's Senior Community Services Program. It is agreed
that the principal activites of such program will be carried on between the .
hours of 8:00 a.m. and 5:00 p.m. and at other hours deemed as necessary by
Lessee to fulfill the functions and activities of said program.
Seventh. That Lessee will not sublet said premises, or any part thereof,
to any person or persons whatsoever, without the consent of said Lessor, in
writing, thereto first obtained.
Eighth. That on failure to pay the rent in advance, as aforesaid, or comply
with any of the foregoing obligations, or in violation of any of the foregoing
covenants, the Lessor may declare this lease forfeited at its discretion and its
agent or attorney shall have the power to enter and hold, occupy and repossess
the entire premises hereinbefore described, as before the execution of these
presents.
Ninth. Either party hereto may cancel this lease by giving the other
party sixty (60) days written notice.

Tenth. Upon completion of the cleaning and painting required in the
first clause hereof, Lessor will provide a statement to Lessee indicating
the cost hereof. If this lease is cancelled during the first year term.
Lessee agrees to pay Lessor for the reasonable cost of such cleaning and
painting.
IN WITNESS WHEREOF, the said parties have hereunto set their hand, in
duplicate, binding the respective parties this, the 11p -W day of
January, 1974.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you.suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
