HomeMy WebLinkAbout11885 ORD - 01/23/1974. • JRR:jkh:1-9 -74; let AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 17, "B -5" PRIMARY BUSINESS DISTRICT REGULATIONS, SECTION 17 -2, ITEM (1) SO AS TO PROHIBIT ONE AND TWO- FAMILY DWELLINGS IN SAID DISTRICT; BY AMENDING ARTICLE 18, "B -6" PRIMARY BUSINESS CORE DISTRICT REGULATIONS, SECTION 18-1, LINE 5, SO AS TO REQUIRE PARKING FOR DWELLINGS IN SAID DISTRICT; BY AMENDING ARTICLE 18, SECTION 18 -3 SO AS TO PROVIDE FOR PARKING REGULATIONS FOR DWELLINGS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING FOR SEVERABILITY. • WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the teat of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on January 2, 1974, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAIM BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, at seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter sea, out. 11885 0 .. . 1. 1 1 SECTION 2. That Article 17 "B =5" Primary Business District Regulations, Section 17 -2, Item (1), of the Zoning Ordinance as amended be amended by adding the following words: "except one - family or two - family dwellings," said Item (1) to hereafter read as follows: 11(1) Any use permitted in the 'B -4' General Business District except one - family and two - family dwellings." SECTION 3. That Article 18 "B-6" Primary Business Core District Regulations, Section 18 -1, line 5, of the Zoning Ordinance as amended be amended by adding the words "except for dwellings" following the word "required" and before the words "in recognition," said complete third sentence to hereafter read as follows: "Permitted uses are the same as for the 'B-5' Primary Business District, but no off - street parking is required, except for dwellings,in recognition of the practical difficulty of providing off - street parking for each individual store in the core district." SECTION 4. That Article 18 "B -6" Primary Business Core District negulauxons, aecuion io -s or the zoning urainance as amended be amended by adding thereto the following wording: "for business uses. The parking regulations for dwellings are contained in Article 22 of this Ordinance," said Section 18 -3 to hereafter read as follows: "18 -3 Parking Regulations. There are no parking requirements in the 'B -6' Primary Business Core District for business uses. The parking regulations for dwellings are contained in Article 22 of this Ordinance." SECTION 5. That all ordinances or parts of ordinances in direct conflict herewith are hereby expressly repealed. All other portions and parts of said Zoning Ordinance, as amended, are hereby kept in full force and effect. SECTION 6. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication_ shall contain the caption stating in substance the purpose of the ordinance. SECTION 7. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or. unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, -2- M LJ That the foregoing ordinance was read f the first time an d passed to its second reading on this the i1 day of 19 by the following vote: Jason Luby James T.
