TEXAS:
AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE RELEASES
OF STORM SEWER EASEMENTS, IN THE FORM OF RELEASE
ATTACHED HERETO AND MARKED EXHIBIT "A ", FOR PARCELS
NO. 1 THROUGH 6, 7 -A, 8 AND 13 THROUGH 22, ALL
INCLUSIVE, OF THE WOOLDRIDGE- STAPLES DRAINAGE OUT -
FALL, PROJECT NO. 295- 70 -66; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is authorized to execute releases
of storm sewer easements, in the form of release attached hereto and marked
Exhibit "A ", for Parcels No. 1 through 6, 7 -A, 8 and 13 through 22, all
inclusive, of the Wooldridge- Staples Drainage Outfall, Project No. 295- 70 -66.
SECTION 2. That the necessity to release the above mentioned storm
sewer easements and remove same from the title records of said properties at
the earliest possible date creates a public emergency and imperative public
necessity requiring the suspension of the Charter rule that no ordinance shall
be passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
6th day of February, 1974.

RELEASE OF STORM SEWER EASEMENT
THE STATE OF TEXAS 0
COUNTY OF NUECES 0 KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the City of Corpus Christi had planned the construction
of a drainage outfall from South Staples Street to Rodd Field Road and
between Woolridge Road and Saratoga Boulevard; and
WHEREAS, said project has now become impractical due to financial
difficulties; and
WHEREAS, -
of the County of Nueces, State of Texas, owners of the hereinafter
described tract of land, have dedicated a storm sewer easement to the
City of Corpus Christi for the above site; and
WHEREAS, said easement is recorded at Vol. , Page ,
of the Deed Records of Nueces County, Texas; and
WHEREAS, the City of Corpus Christi no longer has need of the
aforesaid storm sewer easement:
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that the City of
Corpus Christi, for and in consideration of the sum of One Dollar ($1.00),
to it in hand paid by
owners of the hereinafter described tract, has
released and discharged the storm sewer easement described above and by
these presents holds said easement for naught and returns to said owner,
their heirs and assigns, the free and uninterrupted use, liberty, privilege,
and easement of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas, and being described as follows:

TO HAVE AND TO HOLD, all and singular, the rights and privileges
aforesaid to the aforesaid owner, their heirs and assigns. Wherefore,
witness my hand this the day of , 1974.

appeared R. MARVIN TOWNSEND, City Manager of the City of Corpus Christi,
Texas, a municipal corporation, known to me to be the person and officer
whose name is subscribed to the foregoing instrument, and acknowledged to
me that he executed the same as the act and deed of said City of Corpus
Christi for the purposes and consideration therein expressed and in the
capacity therein stated.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
