HomeMy WebLinkAbout11910 ORD - 02/13/1974JRR:jkh:cd:2- 12- 74:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF PARCEL NO. 14 OF THE CLARKWOOD DITCH PROJECT, HIGHWAY 44 TO OSO CREEK, FROM THE OWNER LIONS CLUB OF CORPUS CHRISTI, WESTSIDE; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND $816.50, OF WHICH $768 IS FOR LAND ACQUISITION AND $68.50 IS FOR INCIDENTAL COSTS RELATED TO CLOSING IN CONNECTION WITH THE SAID ACQUISITION, APPLICABLE TO PROJECT NO. 295- 67 -46; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute a real estate sales contract for the acquisition of Parcel No. 14 of the'Clarkwood Ditch Project, Highway 44 to Oso Creek, from the owner, Lions Club of Corpus Christi, Westside, the said parcel being more fully described as follows, to -wit: PARCEL NO. 14 Being a 15.0 foot hide by 256.0 foot long strip of land out of State Survey 402, Nueces County, Texas, said strip of land being more particularly described by metes and bounds as follows: Beginning at the Southeast corner of Block 7, Clarkwood Tocrosite as shown by map of records in Volume 4, page 21, Pnaeces County, Texas Map Records for the Northeast and beginning corner of the tract herein described; Thence S. 10 06' 56" E., with the West boundary line of an existing 40 foot wide drainage ditch, R.O.W., a distance of 256.01 feet to a point in the North right -of -way line of the proposed State Highway 44 cut- off for the Southeast corner of this tract; Thence S. 890 22' 07" W., with the North right of iray line of said High,.-ray 44 cut -off, a distance of 15.01 feet to a point for the Southwest corner of this tract; Thence N. 10 06' 56" W., with a line that is 15.0 feet I•Iest of and parallel to the West boundary line of said existing ditch, a distance of 255.96 feet to a point in the South boundary line of said Block 7, for the Northwest corner of this tract; Thence N. 890 12' 03" E., with the South boundary line of said Block 7, a distance of 15.0 feet to the place of beginning. Containing 3839.77 square feet of land more or less. 11910 SECTION 2. There is hereby appropriated out of the No. 295 Storm Sewer Bond Fund the sum of $836.50, of which $768 is for land acquisition and $68.50 is for incidental costs related to closing in connection with the said acquisition, applicable to Project No. 295- 67 -46. SECTION 3. The necessity to immediately authorize the aforesaid real estate sales contract in order that the City may acquire the necessary parcel or tract of land in order to commence the Clarkwood Ditch Project at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �y of February, 1974.
