HomeMy WebLinkAbout11924 ORD - 02/20/1974J cd:2- 20- 74:lst AN ORDINANCE CLOSING THE 75 -FOOT UNOPENED PORTION OF THAT STREET KNOWN AS STODDART STREET (ALSO KNOWN AS NIMROD STREET), WEST OF WALDRON ROAD BETWEEN LOT 1, BLOCK 3, AND LOT 12, BLOCK 2, OF STODDART SMITH SUBDIVISION UNIT 1, CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SITUATED OFF WALDRON FIELD ROAD WEST OF PURDUE ROAD, SUBJECT TO THE CONDITIONS HEREINAFTER SET FORTH; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing • concerning the closing of a certain 75 -foot unopened portion of Stoddart Street (also known as Nimrod Street), West of Waldron Road, between Lot 1, Block 3, and Lot 12, Block 2, Stoddart Smith Subdivision, Unit 1, in the City of Corpus Christi, was given by publication and registered mail to the last known addresses of the owners of property abutting said street and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, February 13, 1974, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portion of Stoddart Street hereinabove described, subject to the replatting of the adjacent property: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 75 -foot unopened portion of Stoddart Street (also known as Nimrod Street) hereinabove described, in the City of Corpus Christi, be and the same is hereby closed for public use and abandoned to the owners of the abutting property subject to the adjacent property being replatted. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. 11924 U SECTION 3. The necessity to immediately close the aforesaid portion of Stoddart Street for use as a public street and to abandon the same to the owners of abutting property, subject to the abutting property being replatted, so that the aforesaid unopened street may be used for other purposes creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the dateof its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 469 a- day of February, 1974.
