HomeMy WebLinkAbout11925 RES - 02/20/1974JRR:HG:jkh:hb:2 /20/74:1st • A RESOLUTION FINDING THAT THE PROPOSAL BY THE SOUTH TEXAS IN- DUSTRIAL SERVICES, INC., TO CONSTRUCT A SANITARY LANDFILL FOR MATERIALS WHICH MAY BE EXTREMELY HAZARDOUS TO THE HUMAN BODY IN AN AREA 19HOSE DRAINAGE IS A MAJOR TRIBUTARY OF THE NUECES RIVER WATERSHED AND THAT SUCH PROJECT MAY BE A HAZARD TO THE WATER SUPPLY OF THE CITY; EXPRESSING THE OPPOSITION OF THE CITY OF CORPUS CHRISTI TO SUCH CONSTRUCTION AND OPERATION OF SUCH SANITARY LAND- FILL; DIRECTING THE CITY SECRETARY TO FORWARD COPIES OF THIS RESOLUTION TO THE APPROPRIATE AGENCIES; AND DECLARING AN EMERGENCY. WHEREAS, the proposal by South Texas Industrial Services to construct a sanitary fill for materials, many of which may be or are ex- tremely hazardous to the human body, is to be located near Whittset, Texas in an area whose drainage is directly into the Atascosa River, a major tributary of the Nueces River Watershed; and WHEREAS, despite all precautions there can be no guarantee that seepage of heavy metals and other toxic materials will not occur to contam- inate our water supply; and WHEREAS, there are many unknowns regarding the interaction of the various chemicals as to their effect on seepage rate, breakdown end products; and WHEREAS, there are strong doubts as to the efficiency and per- manency of construction; and WHEREAS, the City Council is concerned with the long -term pro- tection of our water supply and have grave doubts of the operative mainten- ance of said landfill; and WHEREAS, the City Council has a responsibility for the health, safety and welfare of the community: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council opposes the construction and operation of a sanitary landfill for disposal of waste tars, pitches, polymer resins, oils, organic and inorganic sludges, solvents, paints, residues, catalysts, heavy metals, salts, metal containers, wood, paper, and plastic, as proposed by the South Texas Industrial Services, Inc. near 11925 Whittset, Texas. SECTION 2. That the City Secretary is hereby authorized to transmit certified copies of this Resolution to the Texas Water quality Board and to any other interested agency deemed necessary. SECTION 3. The necessity to express the City's opposition to the aforesaid project creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the 20th day of February, 1974.
