AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH PROJECT SET FOR A SUMMER COLLEGE
WORK /STUDY PROGRAM, ACCORDING TO THE TERMS AND
CONDITIONS SET FORTH IN THE CERTIFICATE OF AGREE-
MENT, A COPY OF WHICH IS ATTACHED HERETO AND
MADE A PART HEREOF, MARRED EXHIBIT "A "; AND DE-
CLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
to enter into an agreement with Project SET for a summer College Work /Study
Program, all as more fully set forth in the Certificate of Agreement, a
copy of which is attached hereto, marked Exhibit "A ", and made a part
hereof.
SECTION 2. The necessity to authorize the execution of the
aforesaid agreement at the earliest practicable date in order that the
necessary plans and preparations for the institution of the Project SET
program may be commenced creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction and
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and
necessity to exist, and having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,

CERTIFICATE OF AGREEMENT
This AGREEMENT is entered into by City of Corpus Christi

herein after known as the Employing Agency, and Project SET, Summer College Work -
Study Program, herein after known as Project SET entered into on the 6 day of
March , 1974 .
This Agency is a (1) Public (x) organization supported by tax money from the fol
lowing source or sources:

(2) Private, non - profit ( ) organization engaged in the following:

1. Project SET agrees to pay eighty percent (807,) of student salary(ies) as re-
quired by the Higher Education Act of 1965, as amended. The rate of pay will
be two dollars ($2.00) per hour, not to exceed forty (40) hours per week for
twelve {12) weeks. No student may work more than forty (40) hours per week
under Project SET; if they work more hours than this, the Employing Agency is
responsible for the full pay above the forty (40) hours.
2. The above named Employing Agency agrees to pay the remaining twenty percent
(20 %) of said salary(ies) plus:
b. Other employer costs incurred by the employment including 5.857 for admin-
istrative costs, or a TOTAL AGENCY SHARE OF 25.85% of said salary(ies).
3. No student shall be allowed to work more than 480 hours. Any student who re-
aches this limit shall cease to be an employee of the Agency. If an employer
allows a student to exceed 480 hours, the Agency is responsible for 100% of
salary, administrative costs, and other employer expenses.
4. Any of the above funds unexpended at the conclusion of the program, except for
the 5.85% administrative cost contributed by the Employing Agency, will be re-
funded to the Employing Agency twenty days after the last scheduled pay period.
5. The Employing Agency further agrees that the student(s) will be supervised by

who will give proper guidance and counseling to insure proper performance of
services. The supervisor will keep appropriate time records on all students
employed by this Agency under Project SET. These Time Record Sheets are to be
sent to Project SET at the end of each pay period for payroll processing.
6. Work to be performed under this Agreement:
a. Should be related to the student's educational objectives, OR be work in
the public interest which would not otherwise be provided;
b. Will not result in displacement of employed workers or impair existing
contracts for services;
C. Will not involve political activity or work for any political party;
d. Will not involve the construction, operation, or maintenance of any
part of any facility used, or to be used, for sectarian instruction
or as a place of worship.
7. No student will be denied work or be subject to different treatment on the
grounds of race, color, or national origin, and this Agency will comply with
the provisions of the Civil Right Acts of 1964 (PL880352) and the Regulations
of the Department of Health, Education and Welfare which appertain thereto.
8. The Employing Agency assumes full responsibility for providing Workmen's
Compensation Insurance or Liability Insurance for student accepted under
Project SET, as required by and in compliance with Texas statutes.
9. The Agency shall be deemed the employer for the purpose of this Agreement,
as outlined above, and has the right to ultimate direction and control of
the individual in the aerformances of his services.
The employing Agent knows and understands the provision of Project SET, Summer
College Work -Study Program, and agrees to abide by these regulations.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
